邻避冲突的协商治理研究

【摘要】:伴随我们国家的工业化以及城镇化建设的不断推进,近年来我国邻避冲突表现出了高发趋势,对国家安全以及经济安全造成了严重影响。中国共产党十八大以来,国家领导层数次在一些重要会议中明确提出,要健全社会主义协商民主制度,推进我国协商民主广泛、多层、制度化发展,为我国邻避冲突的有效解决指明了明确的方向。社会各界普遍认为,加强协商治理是目前应对邻避冲突问题的必然之路。在这种政治环境下,我国各地方政府纷纷采取了多种形式的协商方式,比如民主恳谈会、座谈会、听证会等应运而生,大大地缓和了政府与社会之间的矛盾,抑制了大规模社会冲突的爆发和扩散。但是,由于邻避冲突本身具有的特征,以及协商民主理论存在的不足,邻避冲突协商治理在实践过程中仍然面临许多方面的问题,诸如公平性问题、效率性问题、价值认同缺失以及协商场域不足等问题,大大影响了协商治理的有效实施。因此,全面地研究邻避冲突协商治理具有十分重要的现实意义。文章紧紧围绕邻避冲突协商治理这一核心命题,分析了当前我国邻避冲突治理的时代背景,详细地说明了加强邻避冲突协商治理在理论方面的作用和在实践方面的作用。在此基础上,详细介绍了国内外有关邻避冲突、协商治理以及邻避冲突协商治理的相关研究和理论成果。详细分析了当前我国邻避冲突协商治理的一般理论,厘清了有关邻避冲突、协商治理以及邻避冲突协商治理等核心概念的主要内涵,同时介绍与邻避冲突协商治理有关的一些基础理论,如社会冲突、协商民主、协同治理,以及公民参与。介绍了当前我国邻避冲突治理实践以及在实践过程中存在的现实问题,例如精英决策模式主导,诱发邻避风险、利益表达渠道缺失,引发邻避冲突、压制型治理促使矛盾升级,并对邻避冲突协商治理的优越性和可行性进行了分析。从优越性来看,邻避冲突的协商治理提倡多元主体共同参与决策过程,拓宽了人们的利益表达渠道,并为邻避冲突的有效治理提供了有力的工具。从可行性性来看,我国国家政策的主导和提倡、多元主体协商意识和协商能力的增强以及传统文化的奠基都为邻避冲突协商治理提供了有力的条件。从公平方面、效率方面、价值认同方面还有协商场域方面四个维度总结了当前我国在邻避冲突协商治理实践过程中存在的一些问题。根据前文理论部分和现状部分的主要内容,针对性地提出推动我国邻避冲突协商治理的对策建议。主要包括:推动我国邻避冲突协商治理的法制化建设;完善我国邻避冲突协商治理的公平机制;优化我国邻避冲突协商治理的效率机制;大力培育社会资本。
[Abstract]:With the development of industrialization and urbanization in our country, the conflict avoidance in our country has shown a trend of high incidence in recent years, which has a serious impact on national security and economic security. Since the 18th National Congress of the Communist Party of China (CPC), the Chinese leadership has clearly stated at several important meetings that it is necessary to improve the socialist consultative democracy system and promote the extensive, multi-layered and institutionalized development of consultative democracy in our country. It points out a clear direction for the effective solution of the conflict avoidance in our country. All walks of life generally believe that strengthening consultative governance is the inevitable way to deal with the problem of conflict avoidance. In this political environment, various local governments in our country have adopted various forms of consultation, such as democratic talks, symposia, hearings, and so on, which have greatly alleviated the contradictions between the government and society. It suppresses the outbreak and spread of large-scale social conflicts. However, due to the characteristics of conflict avoidance itself and the shortcomings of the theory of consultative democracy, the governance of conflict avoidance consultation still faces many problems in practice, such as fairness and efficiency. The lack of value identity and insufficient negotiation field greatly affect the effective implementation of negotiation governance. Therefore, it is of great practical significance to study the governance of neighbor conflict avoidance negotiation. This paper closely revolves around the core proposition of neighbor conflict avoidance negotiation governance, analyzes the background of our country's neighbor conflict avoidance governance, and explains in detail the role of strengthening neighbor conflict avoidance negotiation governance in theory and practice. On this basis, the related research and theoretical results of neighbor conflict avoidance, negotiation governance and neighbor conflict avoidance negotiation governance are introduced in detail. This paper analyzes in detail the general theory of the neighboring conflict avoidance negotiation governance in China, and clarifies the main contents of the core concepts, such as neighbor conflict avoidance, negotiation governance and neighbor conflict avoidance negotiation governance, etc. At the same time, it introduces some basic theories related to the governance of conflict avoidance, such as social conflict, negotiated democracy, cooperative governance, and citizen participation. This paper introduces the practice of adjoining conflict management in our country and the practical problems in the process of practice, such as elitist decision mode leading, inducing neighbor avoiding risk, lack of interest expression channel, causing neighbor avoiding conflict, suppressing governance to promote the escalation of contradiction. The advantages and feasibility of neighbor-conflict-avoidance negotiation governance are analyzed. From the point of view of superiority, the consultative governance of neighboring conflict avoidance advocates the participation of multiple subjects in the decision-making process, broadens the channel of people's interest expression, and provides a powerful tool for the effective governance of neighboring conflict avoidance. From the point of view of feasibility, the leading and advocating of our national policy, the strengthening of multi-subject 's consultation consciousness and ability, and the foundation of traditional culture all provide the powerful conditions for the governance of neighboring negotiation to avoid conflict. From the aspects of fairness, efficiency, value identity and negotiation field, this paper summarizes some problems existing in the practice of adjoining conflict avoidance negotiation governance in our country. According to the main contents of the theoretical part and the present part, the countermeasures and suggestions to promote the conflict avoidance negotiation in China are put forward. The main contents are as follows: to promote the legalization of our country's neighboring conflict avoidance negotiation governance; to perfect the fair mechanism of our neighbor conflict avoidance negotiation governance; to optimize the efficiency mechanism of our neighbor conflict avoidance negotiation governance; to cultivate social capital vigorously.
