我国无居民海岛管理模式研究

【摘要】：随着人类社会发展加速与陆地资源消耗加剧的矛盾日益突出,世界各国开始把眼光转向海洋,大力发展海洋经济,围绕海洋资源开发、海洋科技发展、海洋权益归属等展开了激烈的竞争。而海岛,特别是众多无居民海岛,凭借其丰富的自然资源和其在国际局势中的战略地位,成为了各国海洋竞争的焦点。新中国成立以来,我国从未停止过在无居民海岛管理方面的探索,从最初的军事防御功能导向到“21世纪海上丝绸之路”的提出,中国经济发展对海洋的依赖度逐步加大。《2015年全国海岛管理工作要点》强调要加强对岛礁的管控,为海上丝绸之路提供强力的保障,可见对无居民海岛的管理已经成为我国落实海洋强国战略的重要举措。然而我国无居民海岛管理模式存在着管理理念局限、开发规划制度不完善、专门无居民海岛管理机构缺乏、已有管理机构职能设置单一、无居民海岛管理法律体系不健全等诸多问题,严重阻碍了我国作为海洋大国崛起之路,亟需进行改革完善。我国无居民海岛管理模式的改革完善,既要符合当今国际国内实际情况的要求,又要对我国海洋强国战略有所助益。本文力图通过对中国现行无居民海岛管理模式进行分析,寻找出当前无居民海岛管理模式存在的问题及其原因,同时对美国、马尔代夫、日本等国的无居民海岛管理模式进行剖析,总结其优秀经验,并根据我国具体国情有选择性地借鉴,进而在无居民海岛管理理念、管理制度、管理机构设置、相关法律法规等方面提出对策建议,完善我国无居民海岛管理模式,推动无居民海岛管理的发展,为中国的海洋经济发展、海洋大国崛起提供助力。
[Abstract]:With the contradiction between the accelerating development of human society and the increasing consumption of land resources, countries in the world begin to turn their eyes to the ocean, vigorously develop the marine economy, and focus on the development of marine resources and marine science and technology. The ownership of marine rights and interests has launched a fierce competition. Islands, especially many uninhabited islands, with their rich natural resources and their strategic position in the international situation, have become the focus of marine competition. Since the founding of the people's Republic of China, China has never stopped exploring the management of uninhabited islands, from the original military defense function to the proposal of the "Maritime Silk Road in the 21st Century." China's economic development has gradually increased its dependence on the sea. The key points of National Island Management in 2015 stressed the need to strengthen the control of islands and reefs to provide strong protection for the maritime Silk Road. Therefore, the management of non-inhabitant islands has become an important measure to implement the strategy of ocean power. However, there are some limitations in the management mode of non-inhabitant islands in our country, such as the imperfection of the development planning system, the lack of specialized non-resident island management institutions, and the single function of the existing management agencies. Many problems, such as the unsound legal system of non-resident island management, have seriously hindered our country's way of rising as a marine power, and it is urgent to carry out reform and perfection. The reform and perfection of the management mode of non-inhabitant islands in our country should not only meet the requirements of the actual situation at home and abroad, but also be helpful to the strategy of our country's marine power. This paper tries to find out the problems and causes of the current non-resident island management mode through the analysis of the current management mode of non-resident islands in China, and at the same time, to the United States, Maldives, the United States, The management mode of non-inhabitant islands in Japan and other countries is analyzed, its excellent experience is summarized, and selected reference is made according to the specific conditions of our country, and then the management concept, management system and management organization are set up in the non-inhabitant islands. In order to promote the development of non-resident island management in China, this paper puts forward some countermeasures and suggestions in the aspects of relevant laws and regulations, so as to provide help for the development of China's marine economy and the rise of marine power.
