服务型政府视野下我国行政审批制度改革研究

【摘要】：我国现行的行政审批制度在一定程度上可以说是计划经济下的产物,它符合当时的历史条件和环境,在社会发展的过程中起到过不可代替的积极作用。但随着社会的变革以及经济的发展,尤其是改革开放以来,我国的社会主义市场经济制度得到了空前的发展和完善,我国目前现行的行政审批制度却仍延续计划经济时期的惯性,不能很好的与社会主义市场经济发展相适应,不再满足社会日新月异、经济快速发展的需要。审批繁琐、流程混乱、腐败寻租的乱象屡禁不止。党的十八大提出,要深化行政审批制度改革,继续简政放权,推动政府职能向创造良好发展环境、提供优质公共服务维护社会公平正义转变”。十八届三中全会中提出的“市场决定论”要求让市场在资源配置中起决定性作用。在全面深化改革新时期的当下,切实转变政府职能、构建和完善服务型政府的突破口和关键点都在于深化行政审批制度改革。本文通过对我国行政审批制度改革的理论框架、历史沿革以及存在问题的梳理,并结合美国在政府管制方面的经验,提出了在服务型政府框架和视野下深化我国行政审批制度的管理、运行和监督机制的改革路径。
[Abstract]:The current administrative examination and approval system in our country can be said to be the product of planned economy to a certain extent. It accords with the historical conditions and the environment at that time and has played an irreplaceable positive role in the process of social development. However, with the change of society and the development of economy, especially since the reform and opening up, the socialist market economy system of our country has been developed and perfected unprecedentedly. However, the current administrative examination and approval system in our country still continues the inertia of planned economy period, which can not be well adapted to the development of socialist market economy, and no longer meets the needs of rapid development of society and economy. Examination and approval cumbersome, process chaos, corruption rent-seeking chaos repeatedly prohibited. The 18th National Congress of the CPC proposed that we should deepen the reform of the administrative examination and approval system, continue to streamline government administration and delegate power, promote the transformation of government functions towards creating a good development environment, and provide quality public services to safeguard social fairness and justice. " The "market determinism" proposed by the third Plenary session of the 18th CPC Central Committee requires the market to play a decisive role in the allocation of resources. In the new period of deepening the reform in an all-round way, the breakthrough and key point of the transformation of the government function and the construction and perfection of the service-oriented government lie in deepening the reform of the administrative examination and approval system. This paper combs the theoretical framework, historical evolution and existing problems of the reform of the administrative examination and approval system in China, and combines the experience of the United States in the field of government regulation. This paper puts forward the reform path of the management, operation and supervision mechanism of the administrative examination and approval system in our country under the framework and vision of the service-oriented government.
