政社分开的基础:领导权与治理权分开

【摘要】：政社分开的改革因政府内在的治理逻辑与统治逻辑的矛盾而进展迟缓,这一矛盾来自一种对权力的误解。政社分开的实质是权力的分开,即领导权与治理权的分开。这一分开符合马克思主义的国家理论,也切合政社分开改革的实践。它有助于解决使社会组织和团体真正成为一个独立而自治的组织这一政社分开改革需要解决的首要问题,有助于在基本的功能上划清政府与社会组织的边界,也有助于解决改革内在的治理逻辑与统治逻辑之间的矛盾。领导权与治理权的分开并不意味着政府将治理权全部放手,政府需要在它治理的领域里承担起它的责任,同时政府还承担着对社会组织进行监管的职能。
[Abstract]:The reform of the separation of government and society has made slow progress due to the contradiction between governance logic and ruling logic, which comes from a misunderstanding of power. The essence of the separation of government and society is the separation of power, that is, the separation of leadership and governance. This separation accords with the Marxist theory of the state and with the practice of the reform of the separation of government and society. It helps to solve the primary problems that need to be solved in order to make social organizations and organizations truly an independent and autonomous organization, a separate political and social organization, and to draw the boundary between the Qing Government and the social organization in terms of basic functions. It also helps to solve the contradiction between governance logic and ruling logic. The separation of leadership and governance does not mean that the government should let go of the power of governance. The government needs to assume its responsibility in the field of governance, and the government also bears the function of supervising social organizations.
