从维稳式治理到多中心治理:群体性冲突治理的困境、超越与重构

【摘要】：传统维稳式群体性冲突的治理模式,以政府为单一治理主体,采取封闭式决策与自上而下的宣教模式,以压制对抗、以权代法的思维处置冲突,压制了社会活力和公民自主性,难以满足公民意识觉醒、利益诉求日益多元化的需要。而花钱买平安、法不责众、妥协退让等息事宁人的维稳式治理,又强化了通过扩大事态、抗争获利的社会认知模式,使群体性冲突的治理陷入困境。超越困境,首先,借鉴多中心治理中的"平等参与""责任共担"与"利益共享"理念,避免社会治理权力的政府垄断,建立一个多元主体平等参与、协商合作的治理体系。其次,从信息发布、利益协调、防范预警、及时回应与学习反馈等方面重构治理体系。最后,以激励与约束相匹配、权责利相统一为原则再造群体性冲突事件善治的实现机制。
[Abstract]:The traditional governance mode of group conflict of stability type, taking the government as the single governance subject, adopting the closed decision-making and the top-down mode of propaganda, to suppress confrontation, to deal with the conflict with the thinking of the right instead of the law, has suppressed the social vitality and the citizen's autonomy. It is difficult to meet the needs of citizen consciousness awakening and interest demand becoming more and more diversified. And spending money to buy peace, not to blame the public, compromise and concessions, and so on, peace and stability of governance, but also strengthened through the expansion of the situation, the social cognitive model of profit, so that the governance of group conflict into a dilemma. First of all, we should learn from the concept of "equal participation", "responsibility sharing" and "benefit sharing" in multi-center governance, avoid the government monopoly of social governance power, and establish a multi-subject governance system of equal participation and consultation and cooperation. Secondly, it reconstructs the governance system from the aspects of information release, benefit coordination, precaution and early warning, timely response and learning feedback. Finally, the realization mechanism of good governance of group conflict events is reconstructed by the principle of matching incentives and constraints and unifying power, responsibility and interest.
