教育惩戒权“入规”的舆情调查与思考——兼评《青岛市中小学校管理办法》

【摘要】：由于教育惩戒法律规范缺失,体罚屡禁不止与放弃惩戒看似矛盾却长期并存,成为我国中小学教育的惩戒权困局。2017年2月颁布的《青岛市中小学校管理办法》,在国内首次以地方规章的形式肯定教育惩戒权,引发舆论热议。调查表明,教育惩戒权"入规"为绝大多数中小学教师所赞同,且对教师惩戒意向影响较大,但并不会造成体罚乱局。破解教育惩戒权困局,既要在实践中逐步完善教育惩戒的法律规范,也要在现有法律体系下充分发挥管理规约对教育惩戒权的规制作用。
[Abstract]:Due to the lack of legal norms on education discipline, corporal punishment does not only seem contradictory to giving up punishment, but it coexists for a long time.In February 2017, the measures for the Management of Primary and Middle Schools in Qingdao, which was promulgated in February 2017, affirmed the right of disciplinary education in the form of local rules and regulations for the first time in China, which triggered a heated discussion of public opinion.The investigation shows that the right to discipline in education is approved by most teachers in primary and secondary schools and has a great influence on teachers' disciplinary intention, but it does not result in a disorder of corporal punishment.In order to solve the dilemma of the right of educational punishment, it is necessary to gradually improve the legal norms of educational discipline in practice, and to give full play to the regulatory role of the management statute on the right of educational discipline under the existing legal system.
