论高校处分违纪学生之裁量权的行使偏差

【摘要】：虽然现行教育法规确认了高校处分违纪学生的裁量权,但在实务中陷入失范困境,管教功能弱化。裁量权的行使偏差突出表现为:滥用裁量偏离育人本位;瑕疵裁量降低管教效率;正当裁量难获司法尊让。主要原因包括:高校教工缺乏正当行使裁量权的法治意识;高校学生违纪处分的法制建设不充分;司法裁量权的过度行使侵蚀学术自治权。为规范高校裁量权的行使,建议提高高校内部学生违纪处分制度的司法化程度,将司法审查限定在形式合法性审查范围内,将司法鉴定制度或专家辅助人制度引入司法诉讼。
[Abstract]:Although the current educational laws and regulations confirm the discretion of students who violate discipline in colleges and universities, they fall into a dilemma in practice and weaken their disciplinary function. The deviations of the exercise of discretion are as follows: abuse of discretion deviates from the standard of educating people; defective discretion reduces the efficiency of discipline; proper discretion is difficult to be respected by the judiciary. The main reasons include: the lack of awareness of the rule of law in the proper exercise of discretion by university teaching staff; the inadequate construction of the legal system for disciplinary punishment of college students; and the excessive exercise of judicial discretion erodes academic autonomy. In order to regulate the exercise of discretion in colleges and universities, it is suggested to improve the judicial degree of the disciplinary punishment system of students in colleges and universities, to limit judicial review to the scope of formal legitimacy examination, and to introduce the judicial expertise system or expert assistant system into judicial litigation.
