美国教师联合会组织教师集体谈判活动发展研究

【摘要】:美国教师联合会前身为芝加哥教师联合会,是仅次于全美教育协会的全国第二大教师工会,成立的宗旨在于关注教师成员的利益诉求和促进公立教育质量的提高。由于本身带有明显的工会主义色彩,加之工业领域价值之风的影响,美国教师联合会对集体谈判这种工会手段有着天然的好感。作为调控劳资关系的主要手段之一,20世纪早期集体谈判开始在美国工商业领域得到广泛运用,随着劳工运动的盛行,私人领域集体谈判逐渐发展成熟。由于集体谈判在美国私人企业界取得胜利,公共领域也开始关注并利用集体谈判谋求合法权益。美国教师联合会在20世纪40年代引入集体谈判,60年代,公立学校教师也开始有组织地进行集体谈判。在纽约教师联合会罢教胜利的鼓舞下,集体谈判被更多的教师所认可,随后联邦各州也相继以立法的形式承认教师集体谈判的合法性。此后教师联合会不断调整斗争策略,推动教师集体谈判制度的继续完善,谈判的内容、方式、程序和范围也日臻成熟。教师集体谈判的广泛应用赋予了教师群体在学校事务中更多的话语权和管理权,至20世纪70年代后期,教师集体谈判已经发展成为美国公立教育领域一种普遍的生活方式,承担着协调劳资关系和学校事务、沟通教师与管理者的重任。从工会取向到工会取向与专业取向的融合,从教师与管理者的激烈对抗到双方的平等对话,以教师集体谈判为突破口,教师联合会当前更加关注如何协调好教师的专业发展和提升公立教育质量两者之间的平衡关系。探讨美国教师联合会在组织教师集体谈判过程中的历史经验和自我发展,不仅有助于推进我国教师集体谈判的制度建设和实践发展,弥补我国教师工会在组织教师集体谈判方面的缺失,而且也能够为我国教师工会未来的健康发展提供参考性意见。
[Abstract]:The former Chicago Teachers Union is the second largest teachers' union after the National Education Association. Its purpose is to pay attention to the interests of teachers' members and to promote the improvement of public education quality. Because of its obvious unionism and the influence of industrial value, the American Teachers' Union has a natural affection for collective bargaining. As one of the main means of regulating labor relations, collective bargaining began to be widely used in American industrial and commercial fields in the early 20th century. With the prevalence of labor movement, collective bargaining in the private sector gradually developed and matured. Due to the success of collective bargaining in American private business, the public domain also began to pay attention to and use collective bargaining to seek legal rights and interests. The American Teachers Union introduced collective bargaining in 1940s and 1960s, and public school teachers began to organize collective bargaining. Encouraged by the New York Teachers' Union's strike victory, collective bargaining was recognized by more teachers, and then the federal states recognized the legitimacy of teachers' collective bargaining in the form of legislation. Since then, the teachers' union has constantly adjusted the struggle strategy, promoted the teachers' collective bargaining system to continue to perfect, the negotiation content, the way, the procedure and the scope also matured day by day. The extensive application of collective bargaining of teachers has given teachers more power of speech and management in school affairs. By the late 1970s, collective bargaining of teachers has developed into a universal way of life in the field of public education in the United States. Responsible for the coordination of labor relations and school affairs, communication between teachers and managers. From union orientation to union orientation and professional orientation, from the fierce confrontation between teachers and managers to the equal dialogue between the two sides, teachers' collective bargaining is the breakthrough point. The Union of Teachers is paying more attention to how to balance the professional development of teachers and the quality of public education. To probe into the historical experience and self-development of the American Teachers' Federation in the process of organizing teachers' collective bargaining is not only helpful to promote the system construction and practical development of teacher collective bargaining in our country. It can make up for the deficiency of teachers' union in organizing teachers' collective bargaining, and it can also provide reference advice for the healthy development of teachers' union in our country in the future.
