教师惩戒权的现实失落与理性回归

【摘要】：教师惩戒权是实现教育目的的有效手段,其有一定的合理性。然而当下教师惩戒权处于失落的状态:缺乏国家立法层面的保障、遭遇社会观念意识的冲击、缺乏教师的自我反思与确认。为此我们必须对教师惩戒权的合理性、合法性进行再确认,进而从国家层面完善法律,赋予惩戒权以根本保障,社会层面创设环境,赋予惩戒权运行的氛围,教师自身转变观念,完成惩戒权的自我确认,以便实现教师惩戒权的理性回归。
[Abstract]:Teachers' right to discipline is an effective means to achieve the purpose of education, and it has certain rationality. However, when the right to discipline of teachers is in a lost state: lack of national legislation level of protection, encounter the impact of social concepts and consciousness, lack of self-reflection and recognition of teachers. Therefore, we must reconfirm the rationality and legitimacy of teachers' disciplinary power, and then perfect the law from the national level, endow the disciplinary power with the fundamental guarantee, create the environment at the social level, and give the atmosphere of the operation of the disciplinary power. Teachers themselves change their ideas and complete the self-confirmation of disciplinary power so as to realize the rational return of teachers' disciplinary power.
