陆生政策合法化及其影响因素研究

【摘要】:自1987年台湾开放同胞赴大陆探亲以来,两岸人员往来和经济、文化等各领域交流不断增多。1985年,大陆向台湾学生开放高等教育。台湾方面,也允许大陆学生赴台进行短期的交流学习。近年来,随着大陆教育质量越来越得到认可,加上国民党执政后不断加强两岸关系的政治倾向,使得“陆生三法”修正案最终得以通过。法案正式允许大陆学子赴台大专以上学校接受教育,台湾也初步确认对大陆地区41所高校的学历进行采认。在大陆学生赴台求学以及台湾承认大陆学历的带动下,两岸高校双向交流和资源共享将进一步深化。“陆生三法”修正案的通过为扩大两岸文教交流合作打开新的机遇之门。因而,深入研究陆生政策的制订过程与影响因素,能够为两岸文化教育事业的交流及共同发展提供一定的理论依据与参考,也为大陆的教育法律体系提供一些借鉴。 本研究主要从五个方面来对陆生政策合法化及其背后的教育法律体系进行探讨。首先是对涉及台湾地区陆生政策的“陆生三法”、“政策合法化”等概念进行界定,并阐明了本研究的研究方法及意义。第二部分主要是对“陆生三法”政策制定的背景和具体内容进行了分析,重点分析了“陆生三法”政策合法化的过程,并对提案、一读会、审查、二读会、三读会和公布这六个过程进行探讨。论文的第三部分是根据前面两部分对“陆生三法”的分析进行深入的研究,将这三部法律背后所反映的台湾地区教育法规体系、层级结构一一呈现,将涉及到陆生政策的相关法律进行层级划分,分析整个陆生法律的层级结构,上下级法律的关系。并对教育政策合法化过程所涉及的影响因素进行研究,分析不同影响因素在法治化过程的不同阶段的影响作用。第四部分主要对陆生政策面临的问题与发展趋势进行了研究。最后,论文通过分析提出对大陆政策的启示,希望能为大陆教育法律体系的完善提供一些建议,同时也为两岸文化共同发展提供理论依据。 本文采用了文献法、文本分析法。搜集大量大陆与台湾地区教育法规、体制等相关的法律、著作、期刊、报纸及网络资源,并对高等教育法律法规文本内容进行分析、加工和整理。通过对台湾“陆生三法”的颁布过程及其影响因素的分析,深入探究其教育法律体系结构。通过对台湾法律体系的剖析,借鉴其有益之处,以使大陆教育法律体系更趋向于完善。
[Abstract]:Since Taiwan opened its compatriots to visit relatives in the mainland in 1987, personnel exchanges between the two sides of the Taiwan Strait and exchanges in various fields such as economy and culture have been increasing. In 1985, the mainland opened higher education to Taiwan students. Taiwan also allows mainland students to visit Taiwan for short-term exchange studies. In recent years, with the increasing recognition of the quality of education in mainland China and the political tendency of strengthening cross-strait relations after the Kuomintang came into power, the amendment to the "three laws of Lu Sheng" was finally passed. The bill formally allows mainland students to go to Taiwan's tertiary institutions to receive education, and Taiwan has also preliminarily confirmed the recognition of the qualifications of 41 universities in the mainland. With mainland students studying in Taiwan and Taiwan acknowledging mainland education, the two-way exchanges and resource sharing between the two sides of the Taiwan Strait will be further deepened. The adoption of the amendment opens up new opportunities for the expansion of cultural and educational exchanges and cooperation between the two sides of the strait. Therefore, the in-depth study of the process and influencing factors of the Lu Sheng policy can provide a certain theoretical basis and reference for the exchange and common development of the cultural and educational undertakings between the two sides of the Taiwan Strait, and also provide some reference for the mainland's educational legal system. This study mainly discusses the legalization of land policy and its educational legal system from five aspects. Firstly, it defines the concepts of "three laws of land health" and "policy legalization", and expounds the research methods and significance of this study. The second part mainly analyzes the background and concrete content of the policy formulation of the "three laws of Lusheng", focusing on the process of legalizing the policy of the "three laws of Lusheng", and the proposal, the first reading, the review, the second reading. The third reading session and the publication of these six processes are discussed. The third part of the paper is based on the previous two parts of the analysis of the "Lu Sheng three laws" in-depth study, the three laws reflected behind the education laws in Taiwan, the hierarchical structure of one by one. The related laws related to the land health policy are divided into different levels, and the hierarchical structure of the whole land law and the relationship between the upper and lower laws are analyzed. The influence factors involved in the legalization process of educational policy are studied, and the influence of different influencing factors in different stages of legalization process is analyzed. The fourth part mainly studies the problems and development trend of terrestrial policy. Finally, the paper puts forward the enlightenment to the mainland policy through the analysis, hoping to provide some suggestions for the improvement of the mainland education legal system, and also provides the theoretical basis for the common development of the cross-Strait culture. This paper adopts document method and text analysis method. To collect a large number of laws, works, periodicals, newspapers and network resources related to the educational laws, regulations and systems in Taiwan, and to analyze, process and organize the texts of laws and regulations of higher education. Based on the analysis of the promulgation process and its influencing factors of the "three laws of Land Health" in Taiwan, this paper probes into the structure of its educational legal system. Through the analysis of Taiwan's legal system, draw lessons from its beneficial points, in order to make the mainland's educational legal system more perfect.
