论大学生创业权益的法律保障

【摘要】：大学生创业逐渐成为备受关注的社会的热点现象。通过以创业带动就业,大学生创业在体现大学生自身价值的同时,也能有效的缓解社会就业压力。我国政府相继出台了一系列法律规章,肯定、鼓励、扶持大学生进行创业,为大学生在创业指导、税收优惠、融资贷款等方面的创业权益提供了法律制度保障。但是,在具体创业实践中也存在创业指导缺乏制度约束,,创业立法层次较低,知识产权保护不力,创业制度可操作性不强,社会保障制度不配套等问题,严重影响了大学生创业的热情和创业效果,也说明了我国对于大学生创业权益的法律保障亟需加强。在国外,发达国家非常重视大学生创业权益的法律保障,在创业指导、创业融资、创业社会保障等方面都制定了相应的法律规范,建立了完善的大学生创业权益法律保障体系。参照发达国家的先进经验,为更好的保障大学生创业权益,我国应在确立大学生创业权益法律保障制度立法原则的基础上,通过提升促进大学生创业的立法层次,促进大学生创业具体法律法规建设,完善现有大学生创业权益法律法规,加强大学生创业社会保障法律制度等方式加强大学生创业权益法律保障制度建设,进一步建立和完善大学生创业权益法律保障体系。
[Abstract]:College students' entrepreneurship has gradually become a hot phenomenon in the society. By using entrepreneurship to promote employment, college students' entrepreneurship reflects the value of college students, but also can effectively alleviate the pressure of social employment. Our government has issued a series of laws and regulations, affirming, encouraging, and supporting college students to start a business, which provides a legal system guarantee for university students' entrepreneurial rights and interests in such aspects as entrepreneurship guidance, tax concessions, financing loans and so on. However, there are also some problems in the practice of entrepreneurship, such as the lack of institutional constraints on entrepreneurship guidance, the low level of entrepreneurship legislation, the weak protection of intellectual property rights, the weak operability of the entrepreneurial system, and the lack of a supporting social security system. It seriously affects the enthusiasm and effect of college students' entrepreneurship, and it also shows that the legal protection of university students' entrepreneurial rights and interests needs to be strengthened in our country. In foreign countries, the developed countries attach great importance to the legal protection of university students' entrepreneurial rights and interests, and have formulated corresponding legal norms in the aspects of entrepreneurial guidance, venture financing and social security of entrepreneurship, and have established a perfect legal protection system for university students' entrepreneurial rights and interests. Referring to the advanced experience of the developed countries, in order to better protect the entrepreneurial rights and interests of college students, our country should establish the legislative principles of the legal protection system of the university students' entrepreneurial rights and interests, and improve the legislative level of promoting the university students' entrepreneurship. To promote the construction of specific laws and regulations on university students' entrepreneurship, to improve the existing laws and regulations on university students' entrepreneurial rights and interests, and to strengthen the legal system of university students' entrepreneurial rights and interests by strengthening the legal system of social security for university students' entrepreneurship. We will further establish and improve the legal protection system for university students' entrepreneurial rights and interests.
