大学章程中的高校办学自主权研究

【摘要】：《中华人民共和国高等教育法》已经规定大学必须具备大学章程，但在我国2300多所高校中，具有“宪章”意义的大学章程却非常少。大学章程对法律赋予高校的权利作了细化规定，使高校办学自主权具有程序和内容上的依据。大学通过各自的章程处理自身与政府、社会的关系以及管理本校内部事务，可以规范政府对高校的管理行为，避免政府过度干预而侵害高校办学自主权。因此本文试图从行政法的角度，以大学章程中的高校办学自主权为研究对象，对其现状进行分析，并通过与国外相对完善的大学章程进行比较，促进大学章程对高校办学自主权的保障，最后笔者将对高校办学自主权的落实和完善提出建议。本论文分为四章：第一章是对大学章程的概述，首先从大学章程的定义、特征以及内容方面介绍了大学章程的内涵；其次介绍了大学章程的形成及制定的问题；最后对大学章程的性质及其对政府、高校内部主体及社会其他主体的效力进行研究。第二章是大学章程在高校办学自主权中的价值。对高校办学自主权及其与大学章程的关系进行分析，并通过对我国法规政策中关于高校办学自主权的梳理，从宪法以及行政法的角度对其进行分析，最后得出大学章程在实现高校办学自主权所具有的基础、依据和保障作用。第三章是我国大学章程中高校办学自主权的现状。主要运用抽样文本分析的方法，得出我国高校办学自主权不能得到落实的原因以及存在的问题。第四章是以大学章程推动我国高校办学自主权的实现。通过划分政府与高校之间权力的界限，，厘清高校内部主体间的关系，理顺高校与社会的关系，有效推进我国高校办学自主权的实现。本文对大学章程中的高校办学自主权进行研究，是对高校办学自主权研究的一个新的视角，也是笔者在日后的学习中要进一步深入学习研究的方向。
[Abstract]:The higher Education Law of the people's Republic of China has stipulated that universities must have the university charter, but among the more than 2300 universities in China, the charter of the university charter is very few. The statute of the university specifies the rights conferred by the law, and makes the autonomy of running a university have the basis of procedure and content. Universities deal with their own relationship with the government and the society and manage their internal affairs through their own articles of association, which can regulate the government's management behavior to colleges and universities, and avoid the excessive interference of the government and encroach on the autonomy of running a university. Therefore, from the angle of administrative law, this paper tries to analyze the present situation of the autonomy of running a university in the university charter, and compares it with the relatively perfect university charter in foreign countries. Finally, the author will put forward some suggestions for the implementation and perfection of the autonomy of running a university. This paper is divided into four chapters: the first chapter is an overview of the university charter, first, from the definition, characteristics and content of the university charter introduced the connotation of the university charter, then introduced the formation and formulation of the university charter. Finally, the nature of the university charter and its effect on the government, internal subjects and other subjects of society are studied. The second chapter is the value of university charter in the autonomy of running a university. This paper analyzes the relationship between the autonomy of running a university and the constitution of a university, and analyzes it from the angle of constitution and administrative law by combing the autonomy of running a school in the laws and policies of our country. Finally, the paper draws the foundation, basis and guarantee function of the university charter in realizing the autonomy of running a university. The third chapter is the status quo of the autonomy of universities in the charter of our country. This paper mainly uses the method of sample text analysis to find out the reasons why the autonomy of running a university can not be implemented and the existing problems. The fourth chapter is to promote the realization of the autonomy of colleges and universities. By dividing the limits of power between the government and colleges and universities, we can clarify the relationship between the subjects of colleges and universities, straighten out the relationship between colleges and universities and society, and effectively promote the realization of the autonomy of running schools in our country. This paper studies the autonomy of running a university in the university charter, which is a new angle of view for the study of the autonomy of running a university, and is also the direction for the author to further study and study in the future study.
