论义务教育阶段残疾儿童受教育权保障的家长义务

【摘要】：保障残疾儿童受义务教育的权利不仅是政府的义务,而且是家长的义务。这种家长义务既是道义上的,也是法律上的。我国现有立法对家长义务的认识不到位、对家长义务内容规定不全面、对家长义务未履行时的制裁不合理等制度缺陷是导致残疾儿童受义务教育的入学率低、教育质量不理想的原因之一。从残疾儿童受教育权法制保障的角度讲,更新立法理念,强化家长的义务主体地位,将家长义务全面系统地纳入特殊教育法规体系,并增强其明确性和强制性,是发挥政府主导作用,保障残疾儿童受教育权的重要举措。
[Abstract]:It is not only the duty of government but also the duty of parents to guarantee the right of disabled children to compulsory education. This parental obligation is both moral and legal. The current legislation of our country does not know the parental obligations in place, the provisions on the content of parental obligations are not comprehensive, and the sanctions when the parental obligations are not fulfilled are unreasonable, which result in the low enrolment rate of children with disabilities in compulsory education. One of the reasons for the unsatisfactory quality of education. From the point of view of legal guarantee of disabled children's right to education, we should renew the concept of legislation, strengthen the status of parents' obligation subject, integrate parental obligations into the system of special education laws and regulations in an all-round and systematic way, and enhance their clarity and compulsion. It is an important measure to give play to the leading role of the government and protect the right to education of children with disabilities.
