高校学位授予案件司法审查进路研究:基于两种法律性质定位的考察

【摘要】：高校学位授予权法律性质存在着"国家行政权"和"高校自主权"两种不同定位,这是高校学位授予标准在校规与法律之间冲突的根源。基于"国家行政权"法律性质定位,高校学位授予案件司法审查存在的困境是,运用法律解释方法无法得出"高校学位授予权属于国家行政权"的结论。基于"高校自主权"法律性质定位,高校学位授予案件司法审查进路主要包括:司法审查范围方面应选择"全面审查"模式;司法审查标准方面应以正当性标准为主,以合法性标准为辅;司法审查基准方面程序问题以正当程序为主要基准,与学术目的相关的实体问题以比例原则为主要基准。
[Abstract]:The legal nature of the right of granting degrees in colleges and universities has two different orientations: "national administrative power" and "autonomy of colleges and universities", which is the root of the conflict between the rules and the laws of the standards of granting degrees in colleges and universities.Based on the legal orientation of "state administrative power", the dilemma of judicial review of university degree award cases is that it is impossible to draw the conclusion that "university degree granting power belongs to the state administrative power" by means of legal interpretation.Based on the orientation of the legal nature of "university autonomy", the approach to judicial review of university degree award cases mainly includes: the scope of judicial review should choose the "comprehensive review" mode, the judicial review standard should be based on the legitimacy standard.The standard of legality is taken as the supplement; the procedural issues of judicial review are mainly based on due process, and the principle of proportionality is used as the main criterion for the substantive issues related to academic purposes.
