我国职业教育法的内容改进研究

【摘要】：现代世界职业教育发展经验表明，要构建起规范高效、充满活力的职业教育体系，必须加强职业教育立法，建构完善的职业教育法律体系，为职业教育提供宽广有序的发展空间。没有职业教育的立法，就没有职业教育的健康、持续发展。《中华人民共和国职业教育法》颁布实施以来，职业教育取得了飞速发展，为我国职业教育的改革和发展起到了一定的保驾护航作用，是我国职业教育改革发展史上一个重要的里程碑。随着职业教育发展形势的变化，《职业教育法》在贯彻执行过程中出现了不少“现实无奈”。职业教育改革与发展中存在着一些亟待从法律层面研究解决的问题，需要对我国职业教育法的内容进行彻底的反思。我国职业教育法的内容改进研究是一个具有重大理论意义和实践价值的课题。本论文主要分为五章：第一章，引言。说明本论文的研究缘起、研究目的、研究内容、文献综述、研究意义和研究方法。第二章，我国职业教育法内容改进的概念研究。探讨职业教育法、职业教育法内容分析、职业教育法的内容改进研究三个概念，，阐释它们的质的规定性和基本范畴。第三章，我国职业教育法内容改进研究的标准构建。通过理论分析和事实分析构建我国职业教育法内容改进的分析标准，为我国职业教育法的内容改进分析提供依据。第四章，我国职业教育法的内容改进分析。依据所构建的具体标准对《职业教育法（修订草案）》的结构体系和具体内容进行分析，探讨其中存在的问题及原因。第五章，我国职业教育法的修改意见。针对《职业教育法（修订草案）》中存在的问题，提出相应的修改意见。
[Abstract]:The experience of the development of vocational education in the modern world shows that in order to construct a standardized and efficient vocational education system full of vitality, we must strengthen the legislation of vocational education and construct a perfect legal system of vocational education. To provide broad and orderly development space for vocational education. Without the legislation of vocational education, there will be no healthy and sustainable development of vocational education. Since the promulgation and implementation of the Vocational Education Law of the people's Republic of China, vocational education has made rapid progress, which has played a role in safeguarding the reform and development of vocational education in China. It is an important milestone in the history of vocational education reform in China. With the development of vocational education, there are a lot of "realistic helplessness" in the implementation of Vocational Education Law. There are some problems in the reform and development of vocational education that need to be studied and solved from the legal level, so it is necessary to thoroughly reflect on the contents of the vocational education law in our country. The research on the content improvement of vocational education law in China is of great theoretical significance and practical value. This paper is divided into five chapters: chapter one, introduction. Explain the origin, purpose, content, literature review, significance and research method of this paper. The second chapter, the concept research of the content improvement of the vocational education law of our country. This paper discusses the three concepts of vocational education law, vocational education law content analysis and vocational education law content improvement research, and explains their qualitative definition and basic category. The third chapter, the standard construction of the content improvement research of the vocational education law of our country. Through the theoretical analysis and the fact analysis, the author constructs the analysis standard of the content improvement of the vocational education law of our country, and provides the basis for the content improvement analysis of the vocational education law of our country. The fourth chapter, the content improvement analysis of the vocational education law of our country. The structural system and concrete contents of the Vocational Education Law (revised draft) are analyzed according to the specific standards constructed, and the existing problems and reasons are discussed. The fifth chapter, our country occupation education law revision opinion. In view of the problems existing in the Vocational Education Law (revised draft), the author puts forward the corresponding suggestions.
