包头市工伤预防体系构建及发展模式研究

【摘要】：随着社会工业化程度的提高,工伤事故不可避免。我国实行工伤保险制度,除了保障工伤职工得到医疗救治和经济补偿以外还包括工伤预防工作。工伤保险以保障工伤职工获得待遇支付和职业康复,分散企业工伤风险,提高社会职业健康水平为目标,在安全生产中起到了积极的贡献。我国《工伤保险条例》的颁布,标志着我国工伤保险制度已正式进入规范化、法制化的新时代。但我国市场经济建立不久,工伤保险起步时间不长,在发挥工伤保险的预防作用方面还存在很大差距,工伤保险是市场经济国家安全生产工作的三大支柱(立法、监察和工伤保险)之一。工伤保险实现预防机制主要是通过工伤保险费的咚与支两方面来实现。前者通过调整企业缴纳保险金的差别费率与浮动费率,激励和督促企业从经济效益立场改善安全健康状况,减少工伤事故和职业危害所造成的损失,达到干预工伤预防的作用；后者则是从工伤保险基金提取工伤预防必要费用,直接支持工伤事故和职业危害的预防活动。通过工伤预防,减少事故发生,也就减少了工伤赔付,企业缴纳工伤保险的费率也因此而降低,激发了企业参加工伤保险的积极性；另一方面,成功的工伤预防减少了社会整体资源的破坏,促进了社会健康持续发展,树立了政府的良好形象。但目前,我国工伤保险没有发挥事故预防的主动作用,仍停留在企业发生工伤事故、社会保险支付待遇。本文从包头市实际出发,对包头市迫切需开展工伤预防工作的必要性给予了理论上和现实的论证。基于以上要求本文用四部分内容进行了介绍。第一章介绍我国工伤预防制度的形成及实施现状,第二章属于重要部分,讲述包头市工伤预防制度的实施状况及工伤预防体系存在的问题及原因分析。第三章介绍工伤预防体系在国际上的应用,重点介绍国外部分国家工伤预防体系及给包头市带来的实践经验。第四章从实际分析,结合国际和国内工伤预防工作实施状况,对包头市建立工伤预防体系阐述了本人意见。最后在结论部分,进一步论述预防工作在工伤保险制度的形成与完善中的重要地位。
[Abstract]:With the development of social industrialization, industrial accidents are inevitable. In addition to ensuring medical treatment and economic compensation for industrial injury workers, they also include work injury prevention work. The goal of industrial injury insurance is to ensure that injured workers and staff are paid for and rehabilitated, to disperse the risk of industrial injury in enterprises, and to improve the level of social and occupational health. The promulgation of the regulations on Industrial injury Insurance indicates that the industrial injury insurance system of our country has entered a new era of standardization and legalization. However, the establishment of the market economy in our country is not long after the establishment of the industrial injury insurance system. Industrial injury insurance does not start for a long time, and there is still a big gap in giving play to the preventive role of industrial injury insurance. Industrial injury insurance is the three pillars (legislation) of safe production in market economy countries. The prevention mechanism of industrial injury insurance is mainly realized through the two aspects of industrial injury insurance premium and expenses. The former is realized by adjusting the differential and floating rates of insurance contributions by enterprises. To encourage and urge enterprises to improve their safety and health from the standpoint of economic benefits, to reduce the losses caused by industrial accidents and occupational hazards, and to achieve the function of intervening in industrial injury prevention; the latter is to draw necessary expenses for industrial injury prevention from the industrial injury insurance fund, Direct support for industrial accidents and occupational hazards prevention activities. Through industrial injury prevention, reduce the occurrence of accidents, also reduce the industrial injury compensation, enterprises pay industrial injury insurance rate is also reduced, stimulating the enthusiasm of enterprises to participate in industrial injury insurance; On the other hand, successful industrial injury prevention has reduced the destruction of the overall social resources, promoted the healthy and sustainable development of the society, and established a good image of the government. But at present, China's industrial injury insurance has not played an active role in accident prevention. Still stay in the enterprise accident, social insurance payment. Starting from the reality of Baotou City, This paper gives a theoretical and practical demonstration on the necessity of the urgent work of industrial injury prevention in Baotou City. Based on the above requirements, this paper introduces four parts. The first chapter introduces the formation and implementation of the industrial injury prevention system in China. The second chapter is an important part, which describes the implementation of the industrial injury prevention system in Baotou City, and analyzes the problems and causes of the industrial injury prevention system. Chapter three introduces the international application of the industrial injury prevention system. Focusing on the introduction of the industrial injury prevention system in some foreign countries and the practical experience brought to Baotou City. Chapter 4th analyzes the actual situation of industrial injury prevention at home and abroad, This paper expounds my opinion on the establishment of industrial injury prevention system in Baotou city. Finally, in the conclusion part, it further discusses the important position of prevention work in the formation and perfection of industrial injury insurance system.
