强化工伤保险的工伤预防功能研究

【摘要】：现代的工伤保险制度是“工伤预防-工伤补偿-工伤康复”三位一体的制度体系。工伤预防是随着生产力的进步、经济社会的发展逐渐衍生的功能。工伤预防以事前的政策、技术以及对劳动者的安全教育培训为主要内容，旨在起到事前预防工伤事故发生的作用。它对保护劳动者的生命健康，保证企业的正常生产，促进社会和谐和经济发展具有重要意义，充分有效地发挥工伤保险制度的预防功能，已经受到越来越多国家的重视，成为工伤保险制度发展的一大趋势。当前，我国正处以经济转型的关键时期，企业改革、经济方式转变急需进行，然而当前工伤事故和职业病的形势不容乐观，工伤保险制度“重补偿、轻预防”的问题依然存在,工伤预防功能没有得到有效的发挥，企业安全生产与职业卫生问题仍然存在。因此，必须加快充分发挥工伤预防功能。如何结合我国工伤保险制度和安全生产实际，充分有效的发挥工伤预防的功能，以减少工伤事故和职业疾病的发生是本文研究的出发点。论文首先对工伤保险、工伤预防进行了注释和理论分析。其次，，文章通过相关统计数据，分析了我国工伤保险发展情况以及工伤预防出现的问题；再次，文章研究了国外工伤保险制度发展成熟的国家，分析了其如何发挥工伤预防功能以促进工伤保险的发展；最后，就如何加强我国工伤预防功能的问题，文章提出法律法规、机构管理、基金管理、组织协调、人员培训等多方面措施建议，以达到强化我国工伤保险中工伤预防功能的目的。
[Abstract]:The modern industrial injury insurance system is a trinity of industrial injury prevention-industrial injury compensation-industrial injury rehabilitation. Industrial injury prevention is a function derived from the development of economy and society with the progress of productive forces. The prevention of industrial injury is mainly concerned with the prior policy, technology and safety education and training of workers, and aims to prevent the occurrence of industrial accidents in advance. It is of great significance to protect the life and health of laborers, to ensure the normal production of enterprises, to promote social harmony and economic development, and to give full and effective play to the prevention function of industrial injury insurance system, which has been paid more and more attention to by more and more countries. Become a major trend of the development of industrial injury insurance system. At present, our country is in the critical period of economic transformation, enterprise reform and economic mode change urgently need to be carried out. However, the current situation of industrial accidents and occupational diseases is not optimistic. The problem of "paying more attention to compensation than prevention" still exists in the industrial injury insurance system. The function of industrial injury prevention has not been given full play, and the problems of safety in production and occupational health still exist. Therefore, we must speed up the full play of industrial injury prevention function. The starting point of this paper is how to combine the industrial injury insurance system of our country and the practice of safe production to give full play to the function of industrial injury prevention in order to reduce the occurrence of industrial accidents and occupational diseases. The thesis first carries on the annotation and the theory analysis to the industrial injury insurance, the industrial injury prevention. Secondly, through the relevant statistical data, the article analyzes the development of industrial injury insurance in China and the problems of industrial injury prevention. Thirdly, the article studies the developed countries of foreign industrial injury insurance system. This paper analyzes on how to develop the function of industrial injury prevention in order to promote the development of industrial injury insurance, and finally, on how to strengthen the function of industrial injury prevention in our country, the article puts forward laws and regulations, organization management, fund management, organization coordination, In order to strengthen the function of industrial injury prevention in industrial injury insurance in China, personnel training and other measures are suggested.
