2016年英国金融服务监管的新变化

【摘要】：2016年5月4日,英国议会颁布了《2016年英格兰银行与金融服务法案》,这标志着由货币政策委员会、金融政策委员会和审慎监管委员会共同组成的英格兰银行组织架构正式形成,也预示着英国因金融危机到来而形成的审慎监管局和金融行为管理局的双峰监管在2016年又发生了新的变化。由于英格兰银行监管职责的不断加重,使英国议会加强了对英格兰银行的监督与问责,并通过对《1998年英格兰银行法案》《2000年金融服务与市场法案》的相关内容进行的修改,明确了英格兰银行作为英国的中央银行在英国的经济与市场金融体系中的核心地位。英国金融服务监管此轮的改革重点主要体现在加强银行的治理与问责、国家审计署对央行的治理与问责、追究高级管理人员在企业破产中的监管责任等方面,并力求通过此次英国金融服务监管的改革实现英格兰银行的三大政策委员会在法律上处于平等地位,进一步加强对英格兰银行的治理、提升英格兰银行透明度,确保英格兰银行作为一个整体维护货币和金融稳定,从而促进英国政府与人民的福利的实现。
[Abstract]:On May 4, 2016, the British Parliament enacted the Bank of England and Financial Services Act 2016, which marks the formal formation of the organizational structure of the Bank of England, which is composed of the Monetary Policy Committee, the Financial Policy Committee and the prudential Supervision Committee. It also heralds a new shift in 2016 between the UK's prudential regulator and the Financial Conduct Authority's bimodal supervision of the financial crisis. As a result of the increasing regulatory responsibilities of the Bank of England, the British Parliament has strengthened its supervision and accountability of the Bank of England and adopted amendments to the relevant provisions of the Financial Services and Markets Act 2000 of the Bank of England Act 1998, The Bank of England as the central bank of England in the British economy and the core of the market financial system. The focus of this round of reforms on the supervision of financial services in the United Kingdom is mainly reflected in strengthening the governance and accountability of banks, the governance and accountability of the National Audit Office to the central bank, and investigating the supervisory responsibilities of senior managers in the bankruptcy of enterprises. And strive to achieve the three policy committees of the Bank of England in legal equality through the reform of the supervision of financial services in the UK, further strengthen the governance of the Bank of England, and enhance the transparency of the Bank of England. To ensure that the Bank of England as a whole maintains monetary and financial stability, thereby contributing to the welfare of the British Government and people.
