环境法视角下的“多规合一”研究

【摘要】：随着我国经济社会的发展和城镇化进程的不断加快,生态环境遭到严重破坏,生态用地不断被挤占。而为了加强宏观管理,各部门、各行业制定了名目繁多的诸多规划,但在确定的同一国土空间内,如何实现各部门、各行业之间的协调,实现国土空间的合理利用,以达到生态环境保护的目的成为政府和学者研究的热点。自2008年开始,广州省开展了“多规合一”的试点工作,之后“多规合一”工作开始开展起来。从最初的“三规合一”(三规主要包括经济社会发展规划、城乡规划和土地利用规划)到后来加入生态环境保护规划的“多规合一”,正是体现了经济社会发展中对环境保护的越来越重视。而且,生态环境本就应该是一切发展的前提条件,离开生态环境任何发展都是空谈。本文从环境保护的角度出发,认为“多规合一”工作应该将环境保护纳入考量,并对“多规合一”工作提出建议:首先,系统介绍了我国现行的规划体系,以及“多规合一”的本质和发展历程,指出了“多规合一”的必要性、作用,以及在“多规合一”过程中出现的不考虑环境保护等方面的弊病。其次,具体分析了“多规合一”过程中面临的诸多环境法律方面的问题。不仅是在规划体系方面存在体系庞杂,多部门职权交叉、工作效率低下等问题;在具体的操作过程中存在着规划期限、技术标准等问题;更是存在着生态理念基础差的基础性问题。最后,本文给出了相关的法律建议。建立和完善“多规合一”体系,编制我国综合性的规划法典,通过规划法典的确定,进一步对工作组织机构、编制方法、边界确定等具体方面进行详细的规定,以便在具体的规划中做到有法可依,此外,还对“多规合一”工作的顺利进行,提出了保障性法律建议。
[Abstract]:With the development of economy and society and the acceleration of urbanization, the ecological environment has been seriously damaged and ecological land has been occupied. In order to strengthen macro management, various departments and industries have formulated various plans, but in the same land and space as determined, how to realize the coordination among various departments and industries, and how to realize the rational use of land and space, To achieve the purpose of ecological environmental protection has become the focus of the government and scholars. Since 2008, Guangzhou Province has carried out the pilot work of "multiple rules in one", and then the work of "multiple rules in one" began. From the original "three rules in one" (mainly including economic and social development planning, urban and rural planning and land use planning) to the later "multi-planning integration" of ecological environmental protection planning, It is reflected in the economic and social development of environmental protection more and more attention. Moreover, the ecological environment should be the precondition of all development, any development from the ecological environment is empty talk. From the point of view of environmental protection, this paper thinks that environmental protection should be taken into account in the work of "multi-planning in one", and puts forward some suggestions to the work of "multi-planning in one": first, it systematically introduces the current planning system of our country. As well as the essence and development course of "multiple rules in one", this paper points out the necessity and function of "multiple rules in one", as well as the disadvantages of not considering the environmental protection in the process of "multiple rules in one". Secondly, the paper analyzes many environmental legal problems in the process of "multi-regulation in one". Not only in the planning system, but also in the planning system, there are many problems, such as the system is complicated, the multi-department functions and powers are intersected, the work efficiency is low, and there are some problems in the concrete operation process, such as the planning time limit, the technical standard and so on. Even more, there is a basic problem of poor ecological concept. Finally, this paper gives the relevant legal advice. To establish and improve the system of "integration of multiple rules and regulations", to formulate a comprehensive planning code of our country, and to make further detailed provisions on the specific aspects of work organization, compilation methods, boundary determination, and so on, through the determination of the planning code. In order to make sure that there are laws to follow in the concrete plan, in addition, it also puts forward the safeguard legal suggestion to the smooth progress of the work of "multiple rules in one".
