康芒斯制度经济学方法研究

【摘要】：康芒斯是早期制度经济学派的重要代表,是现代产权理论的先驱者,他非常重视法律制度在社会经济发展中的作用,其制度经济学方法对制度经济学、现代法经济学都产生了重要的影响。本论文尝试利用经济思想分析方法,系统分析康芒斯制度经济思想,从全新角度为揭示康芒斯批判西方主流经济学派与建立法制经济思想提供理论依据。具体来说,从个人经历、罗斯福新政、市场经济体制转型三个方面梳理康芒斯制度经济学产生的历史背景,提出康芒斯制度经济学形成的经济学基础和方法渊源;梳理康芒斯制度经济学的思想基础与基本概念,着重理清康芒斯制度经济学中的集体行动理论;总结康芒斯制度经济学的研究方法,即深入分析康芒斯制度经济学中的观念分析方法、以法制为核心的研究方法、对受洛克个人主义哲学思想影响的主流派方法的批判及对经验归纳法的独特运用;并对康芒斯制度经济学分析方法进行综合评价,剖析康芒斯制度经济学方法对中国市场经济体制改革的启示。通过对康芒斯经济思想分析方法进行较为系统全面的研究,对其制度经济学的现实意义进行了较为具体深入的诠释,可以为中国政治经济学方法论的建立和完善提供借鉴和批判的素材,对成熟的市场经济体制的建设以及国企改革问题中所出现的所有权等产权问题有重要作用。无疑康芒斯的制度经济思想,尤其是法制对经济的作用,对中国经济具有深远的现实意义。
[Abstract]:Commons is an important representative of the early school of institutional economics and a pioneer of modern property rights theory. He attaches great importance to the role of legal system in the development of social economy. Modern law and economics have had an important impact. This paper tries to use the economic thought analysis method to systematically analyze Commons's institutional economic thought. From a new angle, it provides a theoretical basis for revealing Commons's criticism of the western mainstream economic school and the establishment of the economic thought of legal system. Specifically, from his personal experience, Roosevelt's New deal, This paper analyzes the historical background of Commons's institutional economics in three aspects of the transformation of market economy, puts forward the economic foundation and method origin of Commons's institutional economics, combs the ideological basis and basic concepts of Commons's institutional economics. Focusing on clarifying the collective action theory in Commons's institutional economics, summarizing the research methods of Commons's institutional economics, that is, deeply analyzing the conceptual analysis methods in Commons's institutional economics, and taking the legal system as the core research method. This paper criticizes the main schools of thought influenced by Locke's individualism and the unique application of empirical induction, and makes a comprehensive evaluation of Commons's method of institutional economics analysis. This paper analyzes the enlightenment of Commons's institutional economics method to the reform of China's market economy system. Through a systematic and comprehensive study of Commons's economic thought analysis method, The practical significance of its institutional economics is explained in detail, which can be used for reference and critical material for the establishment and perfection of the methodology of Chinese political economy. It plays an important role in the construction of a mature market economic system and in the property rights issues such as ownership arising in the reform of state-owned enterprises. There is no doubt that Commons's institutional and economic thinking, especially the role of the legal system in the economy, To the Chinese economy has the profound realistic significance.
