新时期城镇化背景下农村土地流转问题研究

【摘要】：2011年我国城镇化率首次突破50%,我国城镇化发展进入飞速发展、矛盾凸显的阶段。速度型城镇化发展方式受资源和环境的制约难以继续,新时期城镇化发展更加注重城镇化发展的质量。城市中流动人口过多,给城市生态环境和社会环境造成巨大压力。新时期城镇化以人为核心,把人口市民化作为新时期城镇化的主要发展目标。这就需要通过农村土地流转释放农地对农村转移劳动力的束缚,为农民提供更多财产性收入,促进其市民化。农村土地有序流转对城镇化的持续发展具有十分重要的意义,新时期城镇化发展中坚持的四化同步、集约高效、绿色低碳、文化传承、市场主导、统筹规划等原则又对我国农村土地流转提出具体要求。我国农村土地流转存在许多问题,流转过程中纠纷频发,政府暴力征地拆迁问题更是引起社会的广泛关注,这不利于通过农村土地有序流转促进我国新时期城镇化的发展。关于农村土地流转中利益分配问题、流转农地用途问题、土地财政问题等也成为学界的热点问题,许多学者对农村土地流转进行了研究。国外与我国不同实行土地私有制,但是一些土地交易理论也为我国农村土地流转提供了指导。本文运用政策分析和数据分析的方法,从新时期城镇化对农村土地流转的要求角度展开研究。首先分析了我国城镇化的发展现状,并对我国农村土地流转制度变迁情况进行了梳理,在此基础上,结合新时期城镇化发展要坚持的七个原则,提出新时期城镇化发展对农村土地流转的七点要求;其次,对应上文的七点要求,指出我国农村土地流转存在流转不规范、土地规模效应难实现、流转农地利用缺乏合理规划、流转中市场资源配置作用不足和流转不平衡等问题,削弱了其对城镇化发展的推动作用,并运用相关数据资料对这些问题进行了证明;第三,从农村土地流转相关法律、配套设施、地方政府、市场和城镇化发展不平衡五个方面对农村土地流转存在问题的原因进行了分析。最后,提出新时期城镇化背景下推进我国农村土地流转的建议,包括完善相关法律、创新配套制度、对地方政府进行正确定位、健全农地流转市场、统筹城镇化发展等,希望为促进我国农村土地有序流转,加快新时期城镇化发展提供参考。
[Abstract]:In 2011, the urbanization rate of our country broke through 50% for the first time, the development of urbanization in our country entered the stage of rapid development and the contradiction was prominent. The rapid urbanization development mode was difficult to continue under the restriction of resources and environment. The development of urbanization in the new period pays more attention to the quality of urbanization development. The excessive floating population in the city causes great pressure to the urban ecological environment and social environment. The core of urbanization in the new period is people. Taking the urbanization of population as the main development goal of urbanization in the new period, it is necessary to release the shackles of rural land transfer labor force through rural land circulation, and provide more property income for farmers. To promote the urbanization. The orderly circulation of rural land has a very important significance for the sustainable development of urbanization. In the new period of urbanization development adhere to the "four" synchronization, intensive and efficient, green and low-carbon, cultural heritage. Market leading, overall planning and other principles of rural land transfer in China put forward specific requirements. There are many problems in the circulation of rural land, and disputes occur frequently in the process of circulation. The problem of government violent land requisition and demolition has aroused widespread concern of the society, which is not conducive to promoting the development of urbanization in the new period through the orderly circulation of rural land. Circulation of farmland use, land finance issues have also become a hot issue in academic circles, many scholars on rural land transfer has been studied. Foreign countries and China different from the implementation of private land ownership. However, some land transaction theories also provide guidance for the rural land circulation in China. This paper uses the methods of policy analysis and data analysis. From the perspective of rural land transfer requirements of urbanization in the new period, this paper first analyzes the current situation of urbanization in China, and combs the system changes of rural land transfer in China, on the basis of this. According to the seven principles of urbanization development in the new period, this paper puts forward seven requirements of urbanization development to rural land circulation in the new period. Secondly, in response to the seven points above, the paper points out that the rural land circulation in our country is not standardized, the effect of land scale is difficult to realize, and the transfer of farmland use is lack of reasonable planning. The problems of insufficient allocation of market resources and imbalance of circulation have weakened its role in promoting the development of urbanization, and these problems have been proved by using relevant data. Third, from the rural land transfer related laws, supporting facilities, local governments, market and urbanization development imbalance in five aspects of rural land circulation problems are analyzed. Finally. Put forward the new era of urbanization background to promote the rural land circulation in China, including improving the relevant laws, innovation of supporting systems, local governments to correctly position, improve the circulation of agricultural land market. In order to promote the orderly circulation of rural land and accelerate the development of urbanization in the new period, the author hopes to provide a reference for the development of urbanization.
