论我国土地银行制度的建立与完善

【摘要】：伴随我国改革开放三十年来经济的快速发展,城乡一体化一直是摆在我们面前的重要课题。“三农”问题事关我国国民经济发展全局和小康社会整体建设目标的实现,而发展农村经济,增加农业投入是解决“三农”问题的关键所在,由此,农村土地银行应运而生。土地银行的建立有助于增加农业金融融资渠道,引导社会资金向农业领域汇集,从而促进农业规模化、产业化生产,促进我国农业现代化的实现。当前,土地银行模式的试点工作已经在全国不少地区展开,取得进展的同时也存在着许多问题。另外,我国学者对土地银行的研究集中于金融和农业经济领域,法律层面的研究成果相对较少,这些有限的成果普遍存在不够系统、深入的缺陷,这些问题都直接影响到土地银行制度的进一步发展。本文通过对国外土地银行以及我国部分地区正在进行的试点工作进行考察,厘清土地银行的概念、性质及主要功能,主张应当将土地银行定位为一种专门性的金融机构。通过总结归纳国外土地银行运作的成功经验,结合我国现行土地制度以及现实国情,总结出适应我国发展的土地银行组织架构和运行机制。首先,主张在组织结构方面,应建立不同层次的、专业性的土地银行,并分别明确各自的职能;其次,在业务范围方面,应当以农地抵押融资为基础,以土地承包经营权的贷出为延伸,以资产证券化业务为深化,为农村提供全方位、多角度的金融服务。最后,在总体规划设计、运行机制范围、法律配套服务方面对我国的土地银行制度进行全面阐述。旨在为我国建立适应我国的土地银行制度提供强有力的理论支撑。
[Abstract]:With the rapid economic development of China's reform and opening up in the past 30 years, the integration of urban and rural areas has always been an important issue in front of us. The issue of "agriculture, countryside and farmers" concerns the overall development of the national economy and the realization of the goal of building a well-off society as a whole. The development of rural economy and the increase of agricultural input are the key to solve the problem of "agriculture, rural areas and farmers". Thus, the rural land bank emerges as the times require, and the establishment of land bank helps to increase the channels of agricultural finance financing. To guide the collection of social funds into the agricultural field so as to promote large-scale agricultural production, industrialized production and the realization of agricultural modernization in China. At present, the pilot work of the land bank model has been carried out in many regions of the country. At the same time, there are also many problems. In addition, our scholars' research on land bank is focused on the fields of finance and agricultural economy, and there are relatively few research results at the legal level. These limited results are generally not systematic enough. These problems have a direct impact on the further development of the land bank system. This paper investigates the pilot work being carried out by foreign land banks and parts of our country, and clarifies the concept of land banks. By summing up the successful experience of the operation of foreign land banks, combining the current land system and the actual situation of our country, the author holds that the land bank should be positioned as a specialized financial institution. Summing up the organizational structure and operational mechanism of the land bank adapted to the development of our country. First, it is advocated that different levels and professional land banks should be set up in the organizational structure, and their respective functions should be clarified respectively. Secondly, in terms of the scope of business, We should take the mortgage financing of agricultural land as the foundation, the loan of the land contract management right as the extension, the asset securitization business as the deepening, provide the comprehensive and multi-angle financial service for the countryside. Finally, in the overall planning design, the operation mechanism scope, The purpose of this paper is to provide a strong theoretical support for the establishment of land banking system in China.
