泾川县农村土地承包经营权确权登记颁证中存在的问题调查与对策研究

【摘要】：农业是我国经济发展的基础,土地是农业生产的根本要素,然而随着我国经济社会的发展,现代化程度的逐步提高,出现了许多与土地息息相关的问题,这些问题的产生,不但影响了我国坚守十八亿亩耕地红线政策的落实,更加减少了农业的生产总量,间接地造成了我国的经济损失,导致了我国农村土地政策的不稳定。面对这样的严峻形势,党中央在2008年10月召开的十七届三中全会上,明确提出要求“搞好农村土地确权、登记、颁证工作”。时至今日,历年的中央一号文件,对开展农村土地承包经营权确权登记颁证工作都有相对应的要求,所以开展研究如何解决农村土地承包经营权确权登记颁证工作中存在的问题,加快落实党中央政策,提高农村管理水平和促进农业现代化生产,已经是箭在弦上,刻不容缓了。本文以上述大背景为依据,以甘肃省泾川县经济社会发展实际为基础,以开展农村土地承包经营权确权登记颁证工作为主要研究内容。通过研究农村土地承包经营权确权登记颁证实际工作中存在的问题、分析问题产生的原因、研究对策,得出了以下几点结论:第一:通过对相关方向文献的阅读和研究,对实际工作资料分析汇总整理,探讨泾川县开展农村土地承包经营权确权登记颁证工作,在保障农民合法权益,稳定农户承包权,增加农民财产收入、化解农民土地纠纷和促进农村土地流转方面的重要意义,结合工作中的实际案例,讨论了泾川县农村土地承包经营权确权登记颁证工作发展的现状,找出了存在的问题,分析了问题产生的原因,并针对相应的问题,提出了解决办法。第二:通过对泾川县的农村土地承包经营权确权登记颁证工作深入调查研究发现,虽然有增加农民财产收入、促进农村土地流转等诸多优势,但是相较于其他地区还存在一些主要问题,“有地无证”、“无地有证”、“无地无证”、“有地有证”的矛盾,大量农村青壮年劳动力转移外出,而导致的农村劳动力缺乏,造成农村土地撂荒,发生农村土地承包和经营权分离的矛盾,还有因为过去土地测量工具的落后,村委会领导干部优亲厚友等原因造成的历史遗留问题。第三:在深入分析研究存在问题的基础上,充分结合本地的农村实际情况,归纳概括提出了灵活广泛宣传政策、效益对比提高积极性、提高农业服务质量、充分交流协调预防矛盾纠纷、鼓励农民发展多种经营模式、突出政府协调是解决征地矛盾的主要途径和严格法律程序,确保确权登记颁证顺利进行等12条对策,为解决泾川县农村土地承包经营权确权登记颁证工作中存在的问题,提供了思路,明确了方向。
[Abstract]:Agriculture is the foundation of our country's economic development, and land is the basic factor of agricultural production. However, with the development of our country's economy and society and the gradual improvement of modernization, there are many problems which are closely related to the land. It not only affects the implementation of our country's policy of sticking to the red line of 1.8 billion mu of cultivated land, but also reduces the total amount of agricultural production, indirectly causes the economic loss of our country, and leads to the instability of our country's rural land policy. In the face of such a severe situation, the CPC Central Committee, at the third Plenary session of the 17th CPC Central Committee held in October 2008, made a clear request to "do a good job in rural land confirmation, registration and certification work". To this day, the document No. 1 of the Central Committee of the past years has a corresponding requirement to carry out the registration and issuance of the right to confirm the right to contracted management of rural land. Therefore, it is urgent to carry out research on how to solve the problems existing in the registration and certification of the right of contracted management of rural land, to accelerate the implementation of the policies of the Party Central Committee, to improve the level of rural management and to promote modern agricultural production. Based on the above background, based on the reality of economic and social development in Jingchuan County, Gansu Province, this paper takes the registration and certification of the right of rural land contract management as the main research content. By studying the problems existing in the practical work of the registration and issuance of the right to confirm the contracted management of rural land, analyzing the causes of the problems, and studying the countermeasures, this paper draws the following conclusions: first, by reading and studying the relevant literature, Through the analysis and collation of the actual working data, this paper discusses that Jingchuan County should carry out the registration and certification work of the rural land contract management right, in order to protect the farmers' legitimate rights and interests, stabilize the farmers' contracting rights, and increase the peasants' property income. This paper discusses the present situation of the registration and certification of the right to contract and manage rural land in Jingchuan County, and finds out the existing problems, which is of great significance in resolving the land disputes among farmers and promoting the circulation of rural land. The causes of the problem are analyzed, and the corresponding solutions are put forward. Second: through the in-depth investigation and study on the registration and issuance of the right to confirm the right of rural land contract management in Jingchuan County, it is found that, although there are many advantages, such as increasing the income of farmers' property and promoting the circulation of rural land, and so on, However, compared with other regions, there are still some major problems, such as "having land without certificates," without land and without certificates, "and" having land and certificates, "and a large number of rural young and middle-aged workers are moving out, resulting in a shortage of rural labor. As a result of the abandonment of rural land, the separation of rural land contracting and management rights, and the historical problems caused by the backward land surveying tools and the good relatives and friends of village committee leaders. Third: on the basis of in-depth analysis and study of the existing problems, and fully combining with the actual situation in the local countryside, the paper summarizes and proposes flexible and extensive propaganda policies to improve enthusiasm and improve the quality of agricultural services through comparison of benefits. To fully communicate and coordinate to prevent conflicts and disputes, to encourage farmers to develop diversified business models, to highlight government coordination is the main way to solve the contradiction of land requisition and strict legal procedures, and to ensure the smooth implementation of registration and issuance of the right to confirm 12 countermeasures, etc. In order to solve the problems existing in the registration and issuance of the right to the contracted management of rural land in Jingchuan County, this paper provides a train of thought and a clear direction.
