河南省登封市农村集体建设用地流转中的制度因素探析

【摘要】:随着改革开放步伐的不断加快,我国传统的土地运行制度也发生了变化,其中在对农村集体建设用地的一系列使用权的流转进行严格规范的基础上,对国有土地资源的使用权实施有偿流转的运行制度,就是在土地管理领域中出现的一个新现象。目前,我国农村集体建设用地的使用权流转体系尚处在一个摸索时期,但是近几年来,登封市城镇化率快速提升,2005年登封市城镇化率为36%,2010年登封市城镇化率达到41%,根据规划,预计2020年登封市城镇化率达到55%以上。规划期间,正是登封市产业经济全面提速、全面创新的发展时期,城镇化进程的不断加快势必带来建设用地领域中整体需求的大幅度增长,各项建设用地的供给渠道可以说面临着空前的资源压力。登封市农村集体经营性建设用地流转机制的逐渐形成,应该说和众多因素的合理助推有着很大的关系,在相关方法律制度体系亟待健全的大背景之下,农村集体经营性建设用地的整个流转进程难免会遇到很多现实问题。本文在对农村集体建设用地流转领域进行全面考察调研的基础上,以我国登封市农村集体建设用地的一系列流转实践为研究样本,深入分析登封市农村集体建设用地流转领域的运作现状和遇到的一些实际困难,从一系列的土地资源抽查数据中找出一些规律性的信息进行阐述,并依托这些信息数据来反映、衡量和分析我国农村集体建设用地的宏观把握问题,立足客观实际组建解决土地流转问题的一系列建议和对策,为政府机构进一步规范流转程序、促进耕地和农民的利益的依法保护,搭建出科学的决策依据和基础理论支撑。本文首先阐述了农村集体建设用地流转的相关概念和基础理论;其次,分析了登封区域内农村集体建设用地流转制度体系的运行现状,核心的研究探索涵盖了我国农村集体建设用地流转制度体系的发展变迁、登封市实施流转机制的大致现况以及导致该市实施农村集体建设用地流转途径不畅的各种因素;最后介绍了重庆、成都、广东等地集体建设用地试点的实践情况及其启示,并对国外的农村土地流转经验进行了客观的归纳借鉴,进而立足登封实际,提出了进一步健全和完善登封市农村集体建设用地流转制度的框架设想以及政策性建议,提出了改革完善一系列集体建设用地流转体系的配套机制,为登封市制定和完善土地交易政策、科学合理地解决集体建设用地流转体系中普遍存在的各种问题,理出一条政策建议和理论体系。
[Abstract]:With the quickening pace of reform and opening up, the traditional land operation system of our country has also changed, among which, on the basis of strictly standardizing the circulation of a series of rural collective construction land use rights, It is a new phenomenon in the field of land management to implement the system of paid circulation of the right to use state-owned land resources. At present, the circulation system of rural collective construction land use right in our country is still in a groping period, but in recent years, the urbanization rate of Dengfeng City has increased rapidly. In 2005, the urbanization rate of Dengfeng City was 36. In 2010, the urbanization rate of Dengfeng City reached 41 percent. According to the plan, It is estimated that the urbanization rate of Dengfeng will reach 55% or more by 2020. During the planning period, it was during the period of overall economic acceleration and overall innovation in Dengfeng that the continuous acceleration of the urbanization process is bound to bring about a substantial increase in the overall demand in the field of construction land. Various construction land supply channels can be said to be facing unprecedented pressure of resources. The gradual formation of the transfer mechanism of rural collective management construction land in Dengfeng City should be said to have a great relationship with the reasonable promotion of many factors, under the background that the relevant parties' legal system needs to be improved urgently. The whole circulation process of rural collective management construction land will inevitably encounter many practical problems. Based on the investigation and investigation of the rural collective construction land circulation, this paper takes a series of practice of the rural collective construction land transfer in Dengfeng as the research sample. This paper deeply analyzes the present operation situation and some practical difficulties encountered in the field of rural collective construction land transfer in Dengfeng City, finds out some regular information from a series of land resources spot check data, and relies on these information data to reflect it. To measure and analyze the macro-control of rural collective construction land in our country, to establish a series of suggestions and countermeasures to solve the problem of land circulation based on objective reality, and to further standardize the circulation procedure for government agencies. To promote the protection of the interests of arable land and farmers according to law, and to set up scientific decision-making basis and basic theoretical support. Firstly, this paper expounds the relevant concepts and basic theories of rural collective construction land transfer; secondly, it analyzes the current situation of the system of rural collective construction land transfer system in Dengfeng region. The core research covers the development and changes of the rural collective construction land transfer system in China, the general status of the transfer mechanism in Dengfeng and the various factors that lead to the poor circulation of rural collective construction land in Dengfeng. Finally, the paper introduces the practice and enlightenment of collective construction land in Chongqing, Chengdu and Guangdong, and sums up and draws lessons from the experience of rural land circulation in foreign countries, so as to base itself on the actual situation of Dengfeng. This paper puts forward the framework and policy suggestions for further improving and perfecting the circulation system of rural collective construction land in Dengfeng City, and puts forward the supporting mechanism for reforming and perfecting a series of collective construction land transfer systems. In order to formulate and perfect the land transaction policy in Dengfeng City and solve the problems in the circulation system of collective construction land scientifically and reasonably, a policy suggestion and theoretical system are put forward.
