我国农村土地承包经营权流转制度探析

【摘要】：近一些年来,在农村经济快速发展的同时,我国的传统农业也逐渐转型为现代农业,这导致了大量的农村剩余劳动力向工业和服务业转移,农民不再完全依附于土地。在上个世纪80年代以后,农村土地承包制度开始实施,农户之间自发的开始了土地流转,到如今已经有一定的规模了。土地流转是决定中国农村经济发展程度的重大影响因素之一,因此笔者在叙述其基本内容具体包括性质和特点之后首先要对土地承包经营权流转的基本内容进行叙述,包括其概念、特征。考察农村土地承包经营权在我国的历史沿革。之后,在对基本情况知晓的背景下,笔者提出了土地承包经营权流转制度在法律层面以及实践操作层面出现的问题。提出问题之后就是分析问题,本文的分析问题这部分内容在提出对策的内容中包含。对策的提出包括了法律层面、产权改革、市场化改革和加强政府监管等。具体包括以下几部分：第一部分为绪论,绪论首先叙述了本文的写作背景,表明本文写作对于解决土地承包经营权流转制度问题的重大意义,这也是文本写作的目的。其次介绍了截至目前为止国内外学者对于该问题所作的调查研究并形成的科研成果。最后叙述了本文的写作内容、研究方法、法律依据以及该文章的基本框架。第二部分重点介绍土地承包经营权的基础以及土地承包经营权流转制度的历史沿革,包括土地承包经营权的基础内容及其流转的概念、特征。为缺陷与解决方法的提出提供基础。第三部分在了解前文理论基础的前提下,关于流转制度中存在的问题,笔者试图分别通过法律角度和实践操作角度进行分析。第四部分在分析第三部分提出问题的前提下,分别从法律层面、产权改革、市场化改革和加强政府监管四个方面分析问题并提出对策。
[Abstract]:In recent years, in the rapid development of rural economy, China's traditional agriculture has also gradually transformed into modern agriculture, which has led to a large number of rural surplus labor transfer to industry and service industry, and the farmers no longer completely attached to the land. After the 80s of last century, the rural land contract system began to be implemented and the peasant households were spontaneous. The land circulation has begun to have a certain scale now. Land circulation is one of the important factors that determine the degree of rural economic development in China. Therefore, the author first narrates the basic content of the transfer of land contract management right, including its concept and characteristics after describing its basic content, including its nature and characteristics. The historical evolution of the rural land contract management right in China is investigated. After the knowledge of the basic situation, the author puts forward the problems of the land contract management right circulation system at the legal level and the practical operation level. After the question is put forward, the problem is analyzed. This part of the analysis of this paper puts forward the countermeasures. The countermeasures include the legal level, the reform of property rights, the market-oriented reform and the strengthening of the government supervision. The first part is the introduction.
