农村居民点整理利益分配理论构建与实践优化研究

【摘要】：基于土地发展权建立农村居民点整理利益分配理论,并以武汉市谦森岛典型项目为例进行实证分析,为农村居民点整理理论构建和实践优化提供参考。结果表明:(1)农村居民点整理实质上是土地发展权的转移和交易过程,该过程中土地发展权的价值体现为"建设用地出让价格-(农用地征收价格+开发成本)";(2)农村居民点整理中产生的利益经过了政府和村集体之间、集体和农户之间、农户内部之间的3次分配;(3)现状分配存在土地发展权接收区和发送区衔接方式需多样化、建新区村民需参与土地发展权价值分配、农户之间分配需合理化的优化空间;(4)未来分配可通过设定土地发展权系数、建立挂钩指标交易平台、配置村民标准发展面积、设置土地发展权分配费的政策设计进行优化。基于土地发展权的转移建立农村居民点整理利益分配理论,有利于理顺项目中利益主体之间的关系,显化利益分配存在的问题,为利益分配优化指明方向。
[Abstract]:Based on the land development right, this paper establishes the benefit distribution theory of rural residential land consolidation, and takes the typical project of Qiansen Island in Wuhan as an example to provide a reference for the construction of rural residential land consolidation theory and the optimization of practice. The results show that: (1) Rural residential land consolidation is essentially the transfer and transaction process of land development rights. In this process, the value of the land development right is embodied in the price of construction land transfer (agricultural land expropriation price development cost); (2) the benefits arising from the consolidation of rural settlements pass between the government and the village collective, between the collective and the farmers. (3) the distribution of the present situation needs to be diversified in the receiving and sending areas of land development, and the villagers of the new district should participate in the distribution of the value of the land development right. (4) the future allocation can be optimized by setting up the coefficient of land development right, establishing the trading platform of linked indexes, allocating the standard development area of villagers and setting up the allocation fee of land development right. Based on the transfer of land development right, the theory of interest distribution of rural residential land consolidation is established, which is helpful to straighten out the relationship between the main interests in the project, to manifest the problems existing in the distribution of interests, and to point out the direction for the optimization of the distribution of interests.
