集体经营性建设用地使用权抵押贷款机制研究

【摘要】:目前,农村金融发展的滞后是制约我国农村经济发展的重要因素之一,主要表现为资金外流的同时抵押贷款难、融资难。虽然,我国金融机构推出的小额信用贷款能一定程度上缓解农村融资难问题,但并没有从根本上解决此问题。激活农村大量沉睡的资产,将其资本化才是解决农村融资难的根本出路。其中,抵押贷款是将资产资本化的重要手段。同时,随着集体经营性建设用地入市,其使用权的价值日益显现。因此,实现集体经营性建设用地使用权抵押贷款是解决农村融资难的可行的途径。本文在相关文献梳理的基础上,结合实地调研,对我国集体经营性建设用地使用权抵押贷款进行深入分析,并找出现行集体经营性建设用地使用权抵押贷款存在的问题及成因,完善集体经营性建设用地使用权抵押贷款机制。以期优化农村融资资金来源,促进农民收入提升,从而全面推进城乡一体化进程。首先,在农村集体经营性建设用使用权抵押贷款制度概况和实践概况的基础上,对集体经营性建设用地使用权抵押贷款典型模式进行了对此分析。得出集体经营性建设用地使用权抵押贷款中存在的问题及成因,为完善集体经营性建设用地使用权抵押贷款机制提供思路。其次,在前文分析的基础上提出完善集体经营性建设用地使用权抵押贷款存在问题的方案,构建了市场主导、混合治理与多方监管的完善集体经营性建设用地使用权抵押贷款制度。最后,针对完善集体经营性建设用地使用权抵押贷款的方案提出政策建议,从政府、市场、金融机构三个角度提出完善相关法律法规和市场服务体系、加大金融机构的审查力度等建议。本研究通过对农村集体经营性建设用地使用权抵押贷款分析,并结合相关理论文献的研究的基础上,提出了完善农村集体经营性建设用地使用权抵押贷款机制的建议。笔者认为,完善农村集体经营性建设用地使用权流转机制可以从以下几个方面着手:完善集体经营性建设用地使用权抵押贷款最重要的措施是完善农村的金融环境,特别是担保体系。其次,要加快相关法律法规的制定工作,建立基准地价体系,确定集体建设用地抵押的范围。最后,鼓励农民集体参与到集体经营性建设用地使用权抵押贷款,确立农民自组织的监管地位。
[Abstract]:At present, the lag of rural financial development is one of the important factors restricting the development of rural economy in China. Although the small credit loans offered by financial institutions in our country can alleviate the problem of rural financing to some extent, it does not solve this problem fundamentally. Activating and capitalizing a large number of sleeping assets in rural areas is the fundamental way to solve the problem of rural financing. Among them, mortgage loan is an important means of capitalizing assets. At the same time, with the collective management of construction land into the market, the value of the right to use is increasingly apparent. Therefore, the realization of collective construction land use right mortgage loan is a feasible way to solve the rural financing difficulties. On the basis of combing the relevant documents and combining with the field investigation, this paper makes a deep analysis on the mortgage loan of the right to use the collective operating construction land in China, and finds out the existing problems and causes of the mortgage loan of the right to the use of the collective operating land for construction purposes. Perfect collective management construction land use right mortgage loan mechanism. In order to optimize the sources of rural financing funds, promote the income of farmers, so as to promote the integration of urban and rural areas. First of all, on the basis of the general situation of the mortgage loan system and practice of the right to use in the construction of collective management in rural areas, this paper analyzes the typical mode of mortgage loan of the right to use the collective operating land for construction purposes. The problems and causes in the mortgage loan of the right to use the collective operating construction land are obtained, which provides the train of thought for perfecting the mortgage loan mechanism of the right to the use of the collective operating construction land. Secondly, on the basis of the above analysis, the paper puts forward a scheme to perfect the problems existing in the mortgage loan of collective operating construction land use right, and constructs a market-oriented approach. Mixed governance and multiple supervision of the improvement of collective construction land use right mortgage loan system. Finally, in view of perfecting the scheme of collective operating construction land use right mortgage loan, the paper puts forward some policy suggestions, and puts forward the improvement of relevant laws and regulations and market service system from three angles of government, market and financial institution. Strengthen the examination of financial institutions and other proposals. Based on the analysis of the mortgage loan of the right to use the rural collective operating construction land and the research of relevant theoretical documents, the paper puts forward some suggestions on how to perfect the mortgage loan mechanism of the right to the use of the rural collective operating construction land. The author thinks that the most important measure to perfect the circulation mechanism of rural collective operating land use right is to perfect the rural financial environment, and the most important measure to perfect the collective management construction land use right mortgage loan is to perfect the rural financial environment. Especially the guarantee system. Secondly, we should speed up the formulation of relevant laws and regulations, establish the system of benchmark land price and determine the scope of collective construction land mortgage. Finally, farmers are encouraged to participate in the collective management of construction land use right mortgage loan, to establish the self-organization of farmers regulatory status.
