自贸区原产地规则的比较及对贸易的影响研究

【摘要】：随着区域经济一体化的发展,世界上各种区域经济组织的数量在不断增长,对全球经济的影响也在逐渐加强。自由贸易区是区域组织中最为常见的形式,已经被很多国家或地区采用。截止到2013年3月2号,WTO共有159个成员国,区域贸易协议有546个,已经实施的有354个,几乎所有WTO成员国都涉及了自由贸易协议,很多国家还不止一个。自由贸易区成员国之间相互取消关税,实行自由贸易,对外保持各自独立的关税政策,可以称为半关税同盟。由于自由贸易区内实行零关税,非成员国很可能通过低关税国家转口将产品输入到高关税国家,从而躲避高关税。如此以来,建立自由贸易区为成员国带来的利益就被非成员国免费占有了,长此以往,自由贸易区必将无法存续。因此自由贸易区需要原产地规则来避免非成员国免费攫取自由贸易带来的利益。但是各个自由贸易区的原产地规则也存在差异,而且原产地规则对自由贸易区的贸易又有重要的影响,因此研究自由贸易区原产地规则的差异、作用以及对贸易的影响有着重要意义。文章第一章是绪论,包含了本文研究的目的、意义、方法和创新之处,以及国内外研究的概况。第二章从自由贸易区的渊源入手,过渡到原产地规则的演变、分类和标准。第三章第一部分解读了世界上三大原产地规则标准；第二部分比较了世界上主要自由贸易区的原产地规则,包括完全原产和部分原产；第三部分比较了中国-智利,中国-东盟,中国-新西兰和中国-巴基斯坦自由贸易区的原产地标准,发现上述自由贸易区的原产地规则存在着很大的相似性。第四章第一部分分析了自由贸易区原产地规则在国际贸易中的积极和消极作用；第二部分运用理论分析方法指出了自由贸易区原产地规则对贸易的影响；第三部分利用2003—2012年中国-东盟和北美自贸区的区内贸易数据进行了对比,并针对差异作出了解释。第五章是结论以及政策建议。根据本文前几章的分析,本文提出了对中国如何合理制定原产地规则的一点建议。
[Abstract]:With the development of regional economic integration, the number of regional economic organizations in the world is increasing, and the influence on global economy is gradually strengthened.Free trade area is the most common form of regional organization, which has been adopted by many countries or regions.As of March 2, 2013, there are 159 WTO members, 546 regional trade agreements and 354 regional trade agreements. Almost all WTO members are involved in free trade agreements, and many countries have more than one.Free Trade area (FTA) can be called semi-tariff union by eliminating tariff, carrying out free trade and keeping their independent tariff policy.Because of the zero tariff in the free trade area, non-member countries are likely to export products to high tariff countries through the transit of low tariff countries, thus avoiding high tariffs.Since then, the benefits brought by the establishment of free trade zone for member countries will be free of charge by non-member countries, and in the long run, free trade zones will not survive.So free trade zones need rules of origin to avoid free-trade benefits for non-members.However, there are differences in the rules of origin of each free trade area, and the rules of origin have an important impact on the trade of the free trade area, so the differences of the rules of origin of the free trade area are studied.The role and the impact on trade are of great significance.The first chapter is the introduction, including the purpose, significance, methods and innovations of this study, as well as the general situation of domestic and foreign research.The second chapter starts with the origin of free trade area, and transition to the evolution, classification and standard of rules of origin.The first part of chapter III interprets the three major rules of origin standards in the world; the second part compares the rules of origin of the major free trade zones in the world, including complete origin and partial origin; the third part compares China and Chile.The standards of origin of China-ASEAN, China-New Zealand and China-Pakistan Free Trade area (FTA) show that the rules of origin of the above FTAs are very similar.The first part analyzes the positive and negative effects of the rules of origin of free trade area in international trade, the second part points out the influence of the rules of origin of free trade area on trade by means of theoretical analysis.The third part compares the regional trade data between China-ASEAN and North America Free Trade area from 2003 to 2012, and explains the differences.The fifth chapter is the conclusion and the policy suggestion.According to the analysis of the previous chapters, this paper puts forward some suggestions on how to make rules of origin reasonably in China.
