中国与东盟国家合作治理毒品犯罪的政策研究

【摘要】：中国与东盟各国长期饱受毒品泛滥的危害,虽然各国政府逐年加大打击毒品犯罪的力度,并在该领域内同国际组织展开了广泛的合作,但毒品走私问题依然相当严峻。进入新世纪,毒品犯罪在整个中国一东盟自由贸易区内仍然呈上升的趋势,毒品问题带来了各种社会、政治、经济问题,如艾滋病的传播,尤其是毒品走私与恐怖组织、有组织犯罪、洗钱犯罪等问题之间千丝万缕的联系,对国际社会的影响更为直接和恶劣。毒品问题成为中国一东盟自由贸易区建设的一大障碍,成为非传统安全领域中的严重威胁,也成为区域内各国政府首要解决的问题之一。本文以中国东盟区域毒品问题为切入点,通过分析毒品、中国东盟当前毒品犯罪现状以及当前中国东盟针对毒品犯罪的政策分析,进而提出现存的问题以及解决方法,以期为中国东盟区域治理毒品犯罪的实践提供思路和建议。为此,本文针对中国东盟治理毒品犯罪的政策研究从以下几个方面进行阐述：首先,通过对毒品、毒品犯罪、跨境毒品犯罪等概念进行界定,以及分析治理的内涵,给予毒品犯罪及治理毒品犯罪的刑事政策等问题作出理论阐释。其次,对中国-东盟区域毒品犯罪的基本态势及成因进行阐述。再次,针对当前中国东盟合作治理毒品犯罪政策提出不足与缺陷。当前的政策问题主要集中：禁毒政策过于理想、涉毒人员的治疗政策过于粗放、中国与东盟民间组织抑或基层组织的参与方面存在不足等相关方面。最后,针对第三部分指出的问题提出完善的建议。进而提出最好的社会政策就是最好的刑事政策,得出中国与东盟合作抗制毒品犯罪的政策不仅需要具有全球视野,而且需要考虑到国家、社会和个人的因素,从地方经济发展、替代种植以及涉毒人员的治疗、关怀、就业、跨区域共同治理等方面着手进行综合治理。
[Abstract]:China and ASEAN countries have suffered from drug abuse for a long time. Although the governments of various countries have increased their efforts to crack down on drug crimes year by year and have carried out extensive cooperation with international organizations in this field, the problem of drug smuggling is still quite serious. In the new century, drug crime is still on the rise in the whole China-ASEAN Free Trade area. The drug problem has brought various social, political and economic problems, such as the spread of AIDS, especially drug smuggling and terrorist organizations. Organized crime, money laundering and other issues are inextricably linked to the international community. The drug problem has become a major obstacle to the construction of China-ASEAN Free Trade area, a serious threat in non-traditional security fields, and one of the most important problems to be solved by the governments of various countries in the region. This paper takes the regional drug problem of China and ASEAN as the starting point, through the analysis of drugs, the current situation of drug crime in China and ASEAN, and the current policy analysis on drug crime in China and ASEAN, and then puts forward the existing problems and solutions. In order to provide ideas and suggestions for the practice of controlling drug crime in China-ASEAN region. Therefore, this article aims at the policy research of controlling drug crime in China and ASEAN from the following aspects: firstly, by defining the concepts of drug, drug crime and cross-border drug crime, and analyzing the connotation of governance, To give a theoretical explanation of drug crime and the criminal policy of controlling drug crime. Secondly, the basic situation and causes of drug crime in China-ASEAN region are expounded. Third, the current China-ASEAN cooperation in drug crime policy put forward deficiencies and defects. The current policy problems mainly focus on: drug control policy is too ideal, drug treatment policy is too extensive, China and ASEAN non-governmental organizations or grass-roots organizations in the participation of deficiencies and other related aspects. Finally, the author puts forward some perfect suggestions on the problems pointed out in the third part. And then put forward that the best social policy is the best criminal policy. It is concluded that the policy of cooperation between China and ASEAN in drug control crime not only needs a global perspective, but also needs to take into account national, social and personal factors, and from the local economic development, Alternative planting and drug-related personnel treatment, care, employment, cross-regional joint management and other aspects of comprehensive management.
