大陆居民赴台旅游消费纠纷解决机制研究

【摘要】:我国台湾省是举世闻名的旅游胜地,但由于历史原因,台湾与大陆长期处于政治、经济隔绝状态,近年来,随着全球经济的发展以及两岸观念的转变,2008年7月,两岸在旅游方面首次实现了大陆居民赴台旅游,自此,大陆居民赴台旅游市场开始蓬勃发展。大陆居民赴台旅游目前处于快速发展阶段,随之产生的是大量大陆居民赴台旅游消费纠纷,其中部分纠纷未能及时有效的得到解决。因此,从长远来看要实现两岸旅游交流的稳定发展,完善多元化的纠纷解决机制为重中之重。 大陆居民赴台旅游消费纠纷解决机制的建立涉及到大陆与台湾地区两岸法制的差异,法制的差异根源于两岸政治、经济、文化、社会制度的差异。要想真正解决大陆居民赴台旅游消费纠纷,建立较为完善的两岸旅游消费纠纷解决机制,考虑到两岸的特殊政治关系,更应充分发挥两岸政府主导作用,通过民间机构,以准政府、准官方形式协调解决大陆居民赴台旅游消费纠纷,互设旅游办事处,建立常态化的沟通机制,进而合理协调各种途径解决大陆居民赴台旅游消费纠纷。 在构建大陆赴台旅游消费纠纷解决机制时要坚持以“一国两制”为指导思想,考虑到两岸的特殊情况,参照借鉴国际成功经验,强化两岸政府职能部门在保护两岸旅游消费者权益中的管理和协调作用,保障大陆赴台旅游消费者的合法权益。加强两岸间的旅游交流,协调两岸间的旅游消费法律制度,进一步加强两岸旅游行政管理部门之间的沟通和交流,建立起民间准官方沟通的有效协调机构,两岸进行友好磋商、妥协,最终达成区域性的协议,进而完善大陆赴台旅游消费纠纷的解决机制。规范大陆赴台旅游纠纷解决机制可以说是民心所向,这一举措具有非常深远的意义,,不仅可以推动台湾地区旅游市场的发展,增进两岸之间相互理解,而且还可以对两岸的繁荣发展起到一定的促进作用。
[Abstract]:Taiwan Province is a world-famous tourist destination, but due to historical reasons, Taiwan and the mainland have been in a state of political and economic isolation for a long time. In recent years, with the development of the global economy and the change of the concept of the two sides of the strait, the two sides of the strait have realized the tourism of mainland residents to Taiwan for the first time in July 2008. Since then, the tourism market of mainland residents to Taiwan has begun to flourish. At present, the tourism of mainland residents to Taiwan is in the stage of rapid development, followed by a large number of disputes over tourism consumption of mainland residents to Taiwan, some of which have not been resolved in a timely and effective manner. Therefore, in the long run, to achieve the stable development of cross-strait tourism exchanges, improve the diversified dispute resolution mechanism is the most important. The establishment of dispute resolution mechanism for tourism consumption of mainland residents in Taiwan involves the differences in legal system between the mainland and Taiwan, and the differences in legal system are rooted in the differences in political, economic, cultural and social systems between the two sides of the strait. In order to truly solve the tourism consumption disputes between mainland residents in Taiwan, establish a relatively perfect mechanism for resolving cross-strait tourism consumption disputes, and take into account the special political relations between the two sides of the strait, we should give full play to the leading role of the cross-strait government, coordinate the settlement of tourism consumption disputes between mainland residents in Taiwan in the form of quasi-government and quasi-government through private institutions, set up tourism offices each other, and establish a regular communication mechanism. Then reasonable coordination of various ways to solve mainland residents to Taiwan tourism consumption disputes. In constructing the dispute resolution mechanism of mainland tourism consumption to Taiwan, we should adhere to the guiding ideology of "one country, two systems", take into account the special circumstances of the two sides of the strait, refer to the successful international experience, strengthen the management and coordination role of the government departments on both sides of the strait in protecting the rights and interests of tourism consumers on both sides of the strait, and protect the legitimate rights and interests of mainland tourism consumers in Taiwan. We will strengthen tourism exchanges between the two sides of the strait, coordinate the legal system of tourism consumption between the two sides of the strait, further strengthen communication and exchanges between tourism administrative departments on both sides of the strait, establish an effective coordination organization for private quasi-official communication, conduct friendly consultations, compromise, and finally reach regional agreements, so as to improve the settlement mechanism of tourism consumption disputes between the mainland and Taiwan. Standardizing the dispute resolution mechanism of mainland tourism to Taiwan can be said to be the aspiration of the people. This measure is of great significance. It can not only promote the development of the tourism market in Taiwan and enhance mutual understanding between the two sides of the strait, but also play a certain role in promoting the prosperity and development of the two sides of the strait.
