【摘要】：与国家法中心主义下的立法程序研究不同,对民族习惯法订立的实践逻辑研究,需从规范多元主义出发展开"过程一事件分析"。基于贵州省支嘎布依族苗族彝族乡的法律人类学考察发现,当下民族习惯法的制定过程为:第一步是国家启动,村委行动,立约领导小组起草讨论稿;第二步是村委扩大会议审议讨论稿后形成征求意见稿;第三步是群众会讨论修改征求意见稿后形成草案;第四步是乡立约工作领导小组审核草案;第五步是村民会议表决通过,公示并报乡政府备案。深入探究可知,当下民族习惯法订立的实践逻辑呈现出乡镇监控、村委操办、农民失能的图景。
[Abstract]:Different from the study of legislative procedure under the centralism of national law, this paper studies the practical logic of the establishment of national customary law. Based on the investigation of Yi nationality of Jiga Buyi nationality in Guizhou Province, it is necessary to start from the normative pluralism and find out from the legal anthropology of the Miao nationality Yi nationality Township of Jiga Buyi nationality in Guizhou Province. The current national customary law formulation process is as follows: the first step is the start of the country, village committee action, contract leading group to draft the discussion draft; The second step is the village committee to expand the meeting after the discussion of the draft to form a draft for comments; The third step is that the masses will discuss the revision of the draft and form a draft. The 4th step is the draft of the township contract work leading group to examine and approve; The 5th step is passed by the villagers' meeting and reported to the township government for the record. Further study shows that the practical logic of the current ethnic customary law is the village and township monitoring, the village committee handling, and the peasants' disability.
