党内法规体系建设重在实效

【摘要】：党的十八届四中全会审议通过的《中共中央关于全面推进依法治国若干重大问题的决定》第一次明确地提出了"形成完善的党内法规体系"的要求,并将"党内法规体系"融入"中国特色社会主义法治体系"之中,使得"党内法规体系"建设成为全面推进依法治国各项法治工作的重要目标和任务。党内法规体系建设要注重实效性,应当从以下几个方面来加强党内法规实效性机制建设:要强化党内法规实施的组织保障体制建设。解决上下党内法规的效力等级关系问题,根据党领导立法工作的原则,通过及时修改《中国共产党党内法规制定条例》的方式来赋予"设区的市"地方党委制定党内法规的权力。依据科学和合理的分类方法,建立比较科学和完善的"部门党内法规体系"。消除国家立法与党内法规两张皮的问题,确保党内法规简明扼要、实用高效。加强党内体系建设必须要从抓党内法规的规范体系的源头出发,确保党内法规真正在管党治党方面发挥自身的行为指引作用。
[Abstract]:The "decision of the CPC Central Committee on comprehensively promoting the Rule of Law on several important issues" adopted by the fourth Plenary session of the 18 CPC Central Committee for the first time clearly put forward the requirement of "forming a sound system of laws and regulations within the Party". And will "the inner-party laws and regulations system" into the "socialist rule of law system with Chinese characteristics", It makes the construction of "inner-party legal system" become an important goal and task of comprehensively promoting the rule of law work of governing the country according to law, and the construction of inner-party laws and regulations system should pay attention to the actual effect. We should strengthen the construction of the effective mechanism of inner-party laws and regulations from the following aspects: to strengthen the construction of the organizational guarantee system for the implementation of inner-party laws and regulations, to solve the problem of the hierarchical relationship of the effectiveness of the laws and regulations within the Party, and according to the principles of the Party's leading legislative work, Through timely revision of the regulations on the enactment of laws and regulations within the Party of the Communist Party of China, the local party committees of "districts and cities" are given the power to formulate laws and regulations within the Party, according to scientific and reasonable classification methods, Establish a more scientific and perfect system of "departmental laws and regulations", eliminate the problems of national legislation and inner-party laws and regulations, and ensure that inner-party laws and regulations are concise and concise. To strengthen the construction of the inner-party system, we must start from the source of the normative system of the inner-party laws and regulations, and ensure that the inner-party laws and regulations really play a guiding role in managing the Party and governing the Party.
