电子政务环境下我国县处级党政领导干部财产公开的对策研究

【摘要】：领导干部财产公开,重点不在于如何“反”腐,而在于如何“防”腐。“不想贪”靠道德约束,“不敢贪”靠法律震慑,而“不能贪”靠制度控制。财产的公开涉及到领导干部隐私问题,本文认为对领导干部隐私权的保障和限制并不是一个割裂的问题,领导干部享有的是“有限”隐私权。在党和国家领导体制及组织结构中,县处级党政领导干部处于宏观与微观相结合的重要枢纽部位。促进县处级党政领导干部财产公开,关系到党的方针政策能否有效贯彻实施,关系到能否顺利坚持科学发展、推动全面转型、促进富民强国的伟大实践,关系到能否顺利实现“中国梦”的宏伟目标。在我国,移动电话、短信系统、互联网和新型社会化媒体的持续迅猛发展,尤其是智能手机和移动互联网的迅速崛起,构成了庞大而迅捷的社会信息传播网络,形成了开放互动的网络公共空间。电子政务环境下深入推进我国县处级党政领导干部财产公开,沿着科学化、民主化、法制化和规范化的方向发展,是国家长治久安、社会和谐稳定的根本保证。论文共分为七个部分。第一部分绪论,介绍了本文的研究背景与意义,对国内外研究现状进行分析,交代了本文的研究思路、方法及创新之处。第二部分是相关概念界定及理论阐释。概念界定方面涉及电子政务、与电子政务相关的概念、县处级党政领导干部、领导干部财产公开、公民知情权和党政领导干部隐私权,理论方面本文主要运用的是电子治理理论。第三部分介绍我国县处级党政领导干部财产公开的现状,分为三个层面：一是我国县处级党政领导干部财产公开现状的总体概述；二是近年来我国部分试点地区领导干部财产公开的探索,三是对我国历年出台的与领导干部财产公开相关的政策进行分析并做出总结。第四部分对我国县处级党政领导干部财产公开现存问题、问题的成因进行剖析。第五部分主要是对境外领导干部财产公开的经验借鉴,包括美国、英国、法国等国家的经验及我国港澳台地区领导干部财产公开的启示。第六部分提出电子政务环境下促进我国县处级党政领导干部财产公开的对策建议。最后一部分是结论与展望。本文希望通过结合电子政务环境促进我国县处级党政领导干部财产公开顺利实施,最终能有效遏制腐败现象。
[Abstract]:The key to opening up the property of leading cadres lies not in how to "counter" corruption, but in how to "prevent" it. "do not want greed" depends on moral restraint, "dare not covet" by law, and "can't" rely on system control. The disclosure of property involves the privacy of leading cadres. This paper holds that the protection and restriction of the privacy of leading cadres is not a separate issue, and that the leading cadres enjoy the "limited" right of privacy. In the leading system and organizational structure of the Party and the state, the leading cadres of the party and government at the county level are in the important hinge of the combination of macro and micro. To promote the disclosure of the property of party and government leading cadres at the county and government levels is related to the effective implementation of the Party's principles and policies, to the smooth adherence to scientific development, to the promotion of a comprehensive transformation, and to the great practice of enriching the people and strengthening the country. It is related to the successful realization of the grand goal of "Chinese Dream". In China, the rapid development of mobile phone, short message system, Internet and new social media, especially the rapid rise of smart phone and mobile Internet, constitute a huge and rapid social information dissemination network. Formed the open interactive network public space. Under the environment of electronic government affairs, it is the fundamental guarantee for the long-term stability of the country and the harmony and stability of the society to promote the opening of the property of the party and government leading cadres at the county and government levels in our country, and to develop along the direction of science, democratization, legalization and standardization. The paper is divided into seven parts. The first part is introduction, introduces the research background and significance of this paper, analyzes the current research situation at home and abroad, and explains the research ideas, methods and innovations of this paper. The second part is the definition of relevant concepts and theoretical interpretation. The definition of the concept involves e-government, concepts related to e-government, party and government leading cadres at the county level, property disclosure of leading cadres, the right of citizens to know and the right to privacy of party and government leading cadres, In theory, this paper mainly uses the theory of electronic governance. The third part introduces the current situation of the property disclosure of the party and government leading cadres at the county and government levels in China, which is divided into three levels: first, the general overview of the present situation of the property disclosure of the party and government leading cadres at the county and government levels in our country; The second is the exploration of the property disclosure of the leading cadres in some pilot areas in China in recent years, the third is the analysis and summary of the policies related to the property disclosure of the leading cadres issued in our country over the years. The fourth part analyzes the existing problems and causes of the property disclosure of the party and government leading cadres at the county and government levels. The fifth part mainly refers to the experience of oversea leading cadres' property disclosure, including the experiences of the United States, Britain, France and other countries, and the enlightenment of our country's leading cadres' property disclosure in Hong Kong, Macao and Taiwan. The sixth part puts forward countermeasures and suggestions to promote the property disclosure of party and government leading cadres at the county and government level in the environment of e-government. The last part is the conclusion and prospect. This paper hopes to promote the smooth implementation of the property disclosure of party and government leading cadres at the county and government level by combining the E-government environment, and finally effectively curb the corruption phenomenon.
