中国基层领导干部行政伦理失范与治理研究

【摘要】:领导干部是公务员队伍中的特殊群体,是政府行政事务的组织者和执行者。基层领导干部处于行政管理体系的最“底层”,且直接面对行政服务对象,他们在日常行政行为中的一言一行不但决定着行政行为的社会效益,而且关乎着政府在民众心目中形象的确立。改革开放以来,传统观念的侵润,社会现实的纷扰,以及西方各种价值观念的影响和冲击,使得基层行政人员行政行为失范现象屡禁不止,贪污腐败案件频繁发生。基层领导干部作为我国公共服务最基础的环节,是执政者与老百姓之间相互沟通、相互联系的桥梁,因此提升行政人员行政品行就显得尤为重要。所以,探索新形势下中国基层领导干部行政伦理失范治理问题,不仅关系到国家行政效率的现实提升,而且关系到国家治理体系和治理能力现代化的实现,具有当然的理论和现实意义。本文从行政伦理的角度出发,结合当前中国已经颁行的诸项条例法律等,分析并阐述基层领导干部的基本范畴和特点。运用相关理论,首先对中国社会生活、行政系统之内相关领导干部,尤其是基层领导干部行政行为失范的典型案例进行归纳和总结,着重研究了这一群体的角色冲突,行政不作为和腐败现象。其中角色冲突包括个人角色、公共组织角色权力义务冲突,以及政府组织的集体利益与作为行政执行者的公共责任的对立。然后在此基础上,从历史文化环境、地方经济发展水平、行政体制以及监督机制几个方面分析了基层领导干部行政伦理失范的外在客观原因,进而从基层领导干部道德素质、职业素养、价值取向的角度分析了行政伦理失范的内在主观原因。最后,通过对行政伦理失范内外因的分析,提出对基层领导干部进行外部箝制和内在规约的治理对策,即完善行政制度环境建设与增强基层领导干部德性提升的自觉性。其中外部箝制主要从加强行政伦理制度化建设、完善行政伦理法制化建设和建立科学的考核机制三方面入手。而内在规约则聚焦于:提高道德自律,增强基层领导干部公共服务意识和责任意识;加强对基层领导干部职业伦理道德的培育;强化社会主义核心价值观教育。
[Abstract]:Leading cadres are a special group of civil servants and organizers and executors of government administrative affairs. The grassroots leading cadres are at the bottom of the administrative management system and directly face the objects of administrative service. Their words and deeds in their daily administrative actions not only determine the social benefits of the administrative acts, And related to the establishment of the image of the government in the eyes of the public. Since the reform and opening up, the invasion of traditional concepts, social reality, as well as the impact and impact of various values in the West, the administrative behavior of grass-roots administrative misconduct phenomenon repeatedly prohibited, corruption cases occurred frequently. As the most basic link of the public service in our country, the grassroots leading cadres are the bridge between the leaders and the common people, so it is very important to promote the administrative conduct of the administrative personnel. Therefore, to explore the problem of administrative ethics anomie in China's grass-roots leading cadres under the new situation is not only related to the actual improvement of the national administrative efficiency, but also related to the realization of the modernization of the national governance system and governance capacity. It is of course theoretical and practical significance. From the angle of administrative ethics, this paper analyzes and expounds the basic categories and characteristics of the leading cadres at the grass-roots level, combining with the various regulations and laws that have been enacted in China at present. With the help of relevant theories, this paper first sums up and summarizes the typical cases of administrative misconduct of relevant leading cadres in China's social life and administrative system, especially at the grass-roots level, and focuses on the role conflict of this group. Administrative inaction and corruption. Role conflict includes individual role, public organization role, power and duty conflict, and the opposition between collective interest of government organization and public responsibility as administrative executor. Then on this basis, from the historical and cultural environment, the level of local economic development, the administrative system and the supervision mechanism, this paper analyzes the external and objective causes of the administrative ethics anomie of the grass-roots leading cadres, and then analyzes the moral quality of the grass-roots leading cadres. From the angle of professional accomplishment and value orientation, this paper analyzes the internal subjective reasons of administrative ethics anomie. Finally, through the analysis of the internal and external causes of the administrative ethics anomie, the paper puts forward the countermeasures of external restraint and internal regulation of the grassroots leading cadres, that is, to perfect the administrative system environment construction and strengthen the consciousness of improving the moral character of the grass-roots leading cadres. The external clamping mainly starts from three aspects: strengthening the institutionalization of administrative ethics, perfecting the legal construction of administrative ethics and establishing a scientific examination mechanism. The internal rules focus on improving moral self-discipline, strengthening the public service consciousness and responsibility consciousness of grass-roots leading cadres, strengthening the cultivation of professional ethics and morality of grass-roots leading cadres, and strengthening the education of socialist core values.
