新形势下中国共产党制度反腐问题研究

【摘要】：腐败问题处于一个动态变化的过程中,作为抗腐举措——制度反腐,也应随着腐败的变化而不断提出新进路。因此,对新形势下的制度反腐进行研究不仅有助于提高中国共产党反腐倡廉建设的科学化水平,对于推进全面从严治党,推进国家治理体系和治理能力现代化都将具有重要的意义。十八大以来以习近平总书记为代表的新一届领导集体,高度重视反腐倡廉建设,反腐话语“ '老虎'、'苍蝇'一起打”,“把权力关进制度的笼子里”,“打铁还需自身硬”等发人深省。尤其是十八大以来,在全面依法治国深入推动的背景下,作为从根源上治理腐败的制度反腐,在新形势下更是被提高到了前所未有的高度,并取得了举世瞩目的成就。但是在取得成绩的同时,我们也应清醒的认识到,新时期制度反腐还存在不少需要完善的地方。主要表现为:一是廉政文化与制度反腐意识依然存在与制度反腐不相适应的地方,同时,反腐制度建设还存在体系不完善、制度反腐运行落实不到位等方面的问题。“他山之石,可以攻玉”,新时期中国共产党制度反腐建设需要借鉴他国有益的经验。总的看来,这方面的经验借鉴主要有:强化廉政文化建设、加强反腐机构建设、完善的监督体系等,以此为反腐制度的有效运作提供保障。新时期中国共产党制度反腐建设需要在针对当前反腐制度建设存在问题的基础上,在借鉴国(境)外制度反腐经验的基础上,并着眼于中国特色实际,思考新形势下制度反腐的路径。一方面,针对制度的制定要形成前期预防、中期监督、后期惩治的链式结构。另一方面,针对制度的执行过程中存在的有制度不执行、乱执行、软执行的现状,要从多角度出发加强主体的权威性建设、完善问责机制建设,从而不断加强制度执行的自觉性与规范性。
[Abstract]:The problem of corruption is in the process of dynamic change. As an anti-corruption measure, the system anti-corruption should be constantly put forward with the change of corruption. Therefore, the study of institutional anti-corruption under the new situation is not only conducive to raising the scientific level of the construction of the Communist Party of China against corruption and promoting clean government, but also to promoting the comprehensive and strict administration of the party. It will be of great significance to promote the modernization of national governance system and governance ability. The new leadership group, represented by General Secretary Xi Jinping since the 18th National Congress of the Communist Party of China (CPC), has attached great importance to the building of anti-corruption, "fighting tigers and flies together" and "putting power in the cage of the system." The need for good blacksmiths to make good steel is sobering. Especially since the 18th CPC National Congress, under the background of the comprehensive rule of law, as the root of the corruption management system anti-corruption, in the new situation has been raised to an unprecedented height, and has made remarkable achievements. But at the same time, we should also soberly realize that there are still many places to improve the system anti-corruption in the new period. The main manifestations are as follows: first, the culture of clean government and the consciousness of anti-corruption still exist in places which are not suitable for the system anti-corruption, meanwhile, there are still some problems in the construction of anti-corruption system, such as the imperfect system and the imperfect implementation of the system anti-corruption operation and so on. In the new period, the construction of the anti-corruption system of the Communist Party of China needs to learn from the beneficial experience of other countries. Generally speaking, the experience in this field mainly includes: strengthen the construction of clean government culture, strengthen the construction of anti-corruption organization, perfect supervision system and so on, so as to provide the guarantee for the effective operation of anti-corruption system. In the new era, the construction of the anti-corruption system of the Communist Party of China needs to be based on the problems existing in the construction of the current anti-corruption system, on the basis of drawing lessons from the experience of anti-corruption outside the country (territory), and on the reality with Chinese characteristics. Thinking about the path of system anti-corruption under the new situation. On the one hand, the establishment of the system should form a chain structure of early prevention, mid-term supervision and later punishment. On the other hand, in view of the existing situation of system non-implementation, random execution and soft execution in the process of implementing the system, we should strengthen the authority construction of the main body from various angles and perfect the construction of accountability mechanism.
