从多元隔离到多元复合:村干部监督体系的优化路径研究

【摘要】：村民自治实施30多年来,我国农村基层围绕村干部的监督在制度层面已经形成了多元体系,主要包括两个部分:一是乡镇党政机关在乡村三重关系内进行"权力监督权力"的村庄外部监督,二是本村村民在民主自治关系内开展"权利监督权力"的村庄内部监督。然而,行政目标管理责任制在一元化的乡村权力结构作用下,一定程度导致村干部多元监督系统彼此之间的隔离乃至矛盾,部分消解了党内监督、行政监督和法制监督等村庄外部监督的功能,也抑制了村民会议、村务公开和监督机构等村庄内部监督的作用。优化村干部监督体系,须在监督主体的协同性合作、监督要素的系统性整合和监督条件的规范性保障基础上,于建制村域内构建"权力制约权力"的监督结构,形成内部监督与外部监督相互补充、彼此协调的复合式体系。
[Abstract]:Since the implementation of villagers' autonomy for more than 30 years, the supervision of village cadres at the grass-roots level in rural areas in China has formed a pluralistic system at the institutional level. It mainly consists of two parts: one is that the township party and government organs carry out the external supervision of "power supervision power" in the village triple relationship, the other is the village internal supervision of the "right supervision power" in the democratic autonomy relationship of the village villagers. However, under the unified rural power structure, the administrative objective management responsibility system, to a certain extent, has led to the segregation and even contradiction between the multiple supervision systems of village cadres, and partly eliminated the inner-party supervision. The functions of external supervision, such as administrative supervision and legal supervision, also inhibit the functions of village internal supervision, such as village meeting, village affairs publicity and supervision organization. In order to optimize the supervision system of village cadres, it is necessary to construct the supervision structure of "power restricting power" on the basis of the cooperative cooperation of supervisory subject, the systematic integration of supervisory elements and the normative guarantee of supervision conditions. Form the compound system of internal supervision and external supervision that complement each other and coordinate with each other.
