中国共产党党内法规建设的价值导向:从功能主义到规范主义的嬗变

【摘要】：马丁·洛克林提出的功能主义与规范主义的划分,对于分析中国共产党党内法规建设的价值导向与内在逻辑有着重要借鉴意义。在新民主主义革命时期,党中央相对重视党内法规的规制功能与工具价值,通过制定党内法规来解决革命过程中面临的现实问题。这种功能主义导向在社会主义革命与建设时期的特定政治环境中不断强化。"文革"期间,党内法规建设陷入了停滞状态。基于对"文革"惨痛教训的深刻反思,改革开放以来规范主义导向逐步萌芽,党中央更加注重党内法规的限权功能。党的十八大以来规范主义导向进一步强化,促进了党内法规建设的体系化、科学化发展,并推动了依规治党的实践进程。
[Abstract]:The division of functionalism and regularism put forward by Martin Lochlin is of great significance for analyzing the value orientation and internal logic of the inner-party legal construction of the Communist Party of China (CPC). In the period of the new democratic revolution, the CPC Central Committee paid more attention to the regulation function and tool value of the inner-party laws and regulations, and solved the realistic problems in the process of revolution by making the inner-party laws and regulations. This kind of functionalist orientation has been strengthened in the special political environment during the socialist revolution and construction. During the Cultural Revolution, the construction of the inner-party laws and regulations has come to a standstill. Based on the profound reflection on the painful lessons of the Cultural Revolution, the normative orientation has gradually sprouted since the reform and opening up, and the CPC Central Committee has paid more attention to the power-limiting function of the inner-party laws and regulations. Since the 18th National Congress of the Communist Party of China (CPC), the normative orientation has been further strengthened, which has promoted the systematization and scientific development of the inner-party laws and regulations, and promoted the practice of ruling the Party according to regulations.
