争议中的环境正义:问题与路径

【摘要】：环境正义被认为是环境权利与环境义务的对称。从权利与义务视角分析不同群体、不同地区与不同国家在生态权益分配方面的不公平,具有一定合理性,但生态系统本身的整体性、有机性等也使"权利与义务一致性"分析视角具有一定的缺陷,如它不能摆脱经济理性思维模式,而仅仅把人与自然关系简化为物质权益关系与法律关系,忽视了自然界自身的系统性、有机性等特点。应尊重自然的系统性,摒弃机械思维方式,建立"人类命运共同体"的理念;重视自然的有机性,注重城乡之间的"物质交换";重视自然的整体性,发挥政府主导功能,鼓励公众参与,维护好每个人的生态权益。
[Abstract]:Environmental justice is regarded as the symmetry between environmental rights and environmental obligations.It is reasonable to analyze the unfair distribution of ecological rights and interests of different groups, different regions and different countries from the perspective of rights and obligations, but the whole ecosystem itself.The organic nature also makes the angle of view of the consistency of rights and obligations have certain defects, for example, it can not get rid of the economic rational thinking mode, but only simplifies the relationship between man and nature as the relation of material rights and interests and law.Ignore the nature itself systematic, organic and other characteristics.We should respect the system of nature, abandon the mode of mechanical thinking, establish the concept of "human destiny community", attach importance to the organic nature and the "material exchange" between urban and rural areas, attach importance to the integrity of nature and give play to the leading function of the government.Encourage public participation and protect everyone's ecological rights and interests.
