“直”与“法”:情感与正义——与王庆节教授商榷“父子相隐”问题

【摘要】：关于孔子所讲的"父为子隐,子为父隐,直在其中",存在着不同的诠释可能。王庆节教授的思想方法是海德格尔、伽达默尔的哲学诠释学。本文的思想视域是生活儒学及其中国正义论,认为孔子所讨论的话题不是形而下存在者层级的伦理道德、法律、正义问题,而是存在层级的"何谓‘直’"的问题,即是本真情感的直接显现的问题。至于从本真情感到制度建构,即在法律上究竟应当"父子相证"还是应当"父子相隐",在儒家正义论中,这不仅取决于出自仁爱情感的正当性原则,而且取决于顺应时代生活方式的适宜性原则。
[Abstract]:There are different interpretations of Confucius's saying that "father is hidden for son and son is hidden for father". Professor Wang Qingjie's thought method is Heidegger, Gadamer's philosophy hermeneutics. The ideological horizon of this paper is life Confucianism and its Chinese theory of justice. Confucius argues that the topic discussed by Confucius is not the ethical morality, law and justice at the level of the existential, but the question of what is "straight" in the hierarchy of existence. That is, the direct manifestation of the true feelings of the problem. In the Confucian theory of justice, it not only depends on the legitimacy principle of benevolence emotion, but also on whether it should be proved by father and son or hidden by father and son in law. And it depends on the principle of adaptation to the life style of the times.
