依赖性、社会契约论与能力进路——以残障的正义问题为讨论域

【摘要】：依赖性是一种人类生存状况,在人的生命历程中不可逃避,因此,应该考虑把依赖性作为正义的起点。社会契约理论的两个显著特征,即契约主体是自由、平等和独立的和所有公民以互惠互利为目标,是阻碍其解决残障问题的主要原因。以罗尔斯为代表的现代社会契约论,由于对"大致平等""互惠互利"和"基本益品"理念的社会契约式信奉,也无助于解决这一正义理论的当代难题。针对这一问题,纳斯鲍姆提出了能力进路,并基于核心人类能力、人类尊严和关怀,为解决残疾人问题提供了一种富有洞见的正义路径。
[Abstract]:Dependence is a kind of human living condition, which can not be evaded in the course of human life. Therefore, dependence should be considered as the starting point of justice. The two remarkable characteristics of the theory of social contract, that is, the freedom, equality and independence of the subject of contract and the mutual benefit of all citizens, are the main reasons that hinder them from solving the problem of disability. The modern social contract theory represented by Rawls, because of the belief of "roughly equality", "mutual benefit" and "basic benefit", is not helpful to solve the contemporary problem of justice theory. In order to solve this problem, Nasbaum put forward the path of ability, which is based on the core human ability, human dignity and care, and provides a kind of insightful path of justice for solving the problem of disabled people.
