伦理视野下的自杀权

【摘要】：对于自杀这种现象,人们普遍持反对的观点。反对的理由主要有以下三点:一是因为生命本身有其内在价值;二是因为自杀会伤害其他人;三是因为允许自杀有可能导致权力的滥用。但这些反对观点都为一个更强的理由所压倒,那就是自杀的权利观。这种观点认为每个人都拥有结束自己生命的权利;每个人都有权排除干预以保证权利的实现。文章将讨论有关自杀权的哲学观点。通过分析自杀权的三种不同解释,阐述其将会遇到的理论困难,最后得出结论:自杀权不同于财产权和自主权,也不是自然权利;自杀权从属于生存权——只有在自杀是维护人之尊严的唯一方式的时候,人才有权利选择自杀。
[Abstract]:There is widespread opposition to the phenomenon of suicide. There are three main reasons for objection: one is that life itself has its intrinsic value; the other is that suicide will hurt others; and the third is that allowing suicide may lead to abuse of power. But these objections are overpowered by a stronger reason: the right to suicide. This view holds that everyone has the right to end his own life; everyone has the right to exclude interference to ensure the realization of his rights. The article will discuss the philosophical point of view about the right to suicide. By analyzing three different interpretations of the right to commit suicide, this paper expounds the theoretical difficulties it will encounter, and finally comes to the conclusion that the right to suicide is different from property rights and autonomy, nor is it a natural right; The right to suicide is subordinate to the right to life-only when suicide is the only way to preserve human dignity, people have the right to choose suicide.
