警察涉黑犯罪的成因及对策研究

【摘要】： 目前,国内对黑社会性质组织犯罪已有比较充分的研究,但对警察这一特殊群体涉黑犯罪的研究还不够深入。在警察涉黑犯罪案件日益增多的情况下,深入研究并有效防治警察涉黑犯罪已成为理论界和政法部门所面临的重要课题。本文综合运用比较分析法、案例分析法和文献研究法等方法,对所选取的27个较为典型的警察涉黑案件进行了深入剖析,指出了警察涉黑犯罪的特点、危害、本质和几种主要类型,并从各个层面分析其产生的原因,最后提出了防治警察涉黑犯罪的有效对策。文章由以下三个部分组成: 一、警察涉黑犯罪概述。首先简要介绍了我国黑社会性质组织的历史和现状;然后结合典型案例,着重分析了警察涉黑犯罪的四种表现形式:渗透型、参与型、组织领导型和包庇、纵容型;最后指出警察涉黑犯罪的本质是警察权力的异化和警察角色的易位。二、警察涉黑犯罪成因分析。法社会学认为,犯罪是社会政治、经济、道德、文化等各方面矛盾因素的集中体现。警察涉黑犯罪的发生同样有着多方面的原因。本文主要从思想观念、法律制度和公安内部管理共三个层面入手,结合案例,有针对性的分析了警察涉黑犯罪的成因。三、防治警察涉黑犯罪的对策。警察涉黑犯罪的频发,一再警示我们,采取有效对策,防治警察涉黑犯罪已刻不容缓。根据第二章分析的原因,本文从思想教育、法制建设和公安内部管理制度三个方面相应地提出了防治警察涉黑犯罪的对策。
[Abstract]:At present, the domestic crime of the nature of the black society has been fully studied, but the research on the crime of the police as a special group is not enough.
