论我国娱乐场所的治安监管

【摘要】: 娱乐场所是向公众开放的,消费者自娱自乐的营业性歌舞、游艺等场所,具有娱乐性、公共性、经济性等特征。但娱乐场所在推动社会经济发展的同时,亦诱发了诸如青少年失教、“黄、赌、毒”犯罪猖獗等系列社会问题,其社会负面效应也已成为社会公众关注的焦点。公安机关必须加强娱乐场所的监管。 我国加入世界贸易组织以前,公安机关在对娱乐场所的监管中,实施治安许可程序混乱,乱收许可管理费,治安许可监督不力。现阶段,我国娱乐场所治安监管存在立法不规范和执行监管难等问题。在娱乐场所的治安监管中,公安机关处于权力和责任非对等的状态,监管程序规定错位,公安机关超范围监管,公安机关内部亦分工不明确。存在的主要问题有:一是公安机关对娱乐场所进行事后监督检查难以从根本上监管娱乐场所,难以降低娱乐场所发生违法犯罪的可能性。二是治安监管行政监督检查不严,不规范,执法标准不一。三是治安监管过于依赖行政强制手段,非政府组织作用不明显,行业自律机制缺失、自律作用较弱。 完善规范我国娱乐场所治安监管,要借鉴其他国家或地区的成功经验并结合我国的实际情况,从完善规范娱乐场所监管的立法着手,积极推行娱乐场所治安监管体制改革。依法规范娱乐场所治安监管的具体监管行为;建立预防性控制机制,从加强娱乐场所内部管理的角度出发,运用多种非强制性的行政管理手段对娱乐场所进行控制;推进治安监管行政的民主化改革,刚性管理和柔性管理相结合,发挥非政府组织的功能。
[Abstract]:The entertainment place is open to the public, the consumer amuses oneself the business singing and dancing, the entertainment and so on place, has the entertainment, the public, the economy and so on characteristic. However, while promoting social and economic development, entertainment places have also induced a series of social problems, such as youth failure to teach, "yellow, gambling, drug" and other social problems. Its negative social effects have also become the focus of public attention. Public security organs must strengthen the supervision of entertainment places. Before China joined the World Trade Organization, the public security organs in the supervision of entertainment places, the implementation of security licensing procedures confusion, unauthorized collection of licensing fees, public security permit supervision. At present, there are some problems in the supervision of public order of entertainment places in our country, such as the legislation is not standardized and the supervision is difficult to carry out. In the public security supervision of entertainment places, the public security organs are in the state of non-reciprocal power and responsibility, the regulations of supervision procedure are misplaced, the supervision of public security organs is beyond the scope of supervision, and the division of labor within the public security organs is not clear. The main problems are as follows: first, it is difficult for the public security organs to supervise and inspect the entertainment place after the event, and it is difficult to reduce the possibility of breaking the law and crime in the entertainment place. Second, the administrative supervision of public security supervision and inspection is not strict, non-standard, law enforcement standards are different. Third, public security supervision is too dependent on administrative coercive means, the role of non-governmental organizations is not obvious, the industry self-discipline mechanism is missing, and self-regulation is weak. In order to perfect and standardize the security supervision of entertainment places in our country, we should learn from the successful experiences of other countries or regions and combine the actual situation of our country, start from perfecting the legislation of regulating the supervision of entertainment places, and actively carry out the reform of the public security supervision system of entertainment places. To regulate the concrete supervision behavior of public order in entertainment place according to law, to establish the preventive control mechanism, to control the entertainment place from the angle of strengthening the internal management of entertainment place, and to use a variety of non-compulsory administrative means to control the entertainment place; To promote the democratic reform of the administration of public security supervision, the combination of rigid management and flexible management to give play to the functions of non-governmental organizations.
