巴中市未成年人犯罪调研报告

【摘要】：未成年人犯罪问题一直受全社会普遍关注，也是困扰司法实践部门和法学理论界的一个难题，影响到和谐社会的构建，为全面建设小康社会创造良好环境需要解决的重要课题之一。近年来，虽然国家为预防和减少未成年人犯罪出台了一些法律和政策，然而，未成年人犯罪形势日趋严峻，而且逐步出现年龄低龄化、犯罪手段成人化、团伙化、暴力化等新特点，已成为危害社会安定的一个亟待解决的社会问题。本文通过对巴中市2010年-2012年全市未成年人犯罪案件情况进行调查统计，并对该市未成年人犯罪的原因及预防措施作了一些粗浅的探究。本文共一万七千多字，由四部分组成。第一部分总结巴中市未成年人犯罪的特征。该市未成年人犯罪具有文化低、犯罪低龄化、侵犯财产性犯罪为主、团伙化、犯罪手段智能化、成人化、作案动机单纯等特点，，从而说明该市未成年人犯罪形势日趋严峻。第二部分剖析巴中市未成年人犯罪的原因。未成年人犯罪的原因较多，本部分主要从家庭原因（家庭结构变化、教育方法不当、父母不良影响）、学校原因（办学宗旨不明确、德育和法制教育流于形式、管理制度不健全）、未成年人的不良交往、社会不良环境的影响、未成年人缺乏正确的价值观等方面剖析未成年人犯罪的原因，为探究预防未成年人犯罪措施提供了根据。第三部分探究预防巴中市未成年人犯罪的措施。预防未成年人犯罪的方法较多，本部分主要从家庭预防的角度，（建立和谐美满的家庭、提高家长的教育素质、给家长提供必要的帮助）、从学校预防的角度，（改变应试教育模式、加强未成年人的德育和法制教育、健全学校的管理制度）净化社会环境，防止未成年人不良交往，让未成年人在快乐的氛围中健康成长等方面进行探究，从而减少未成年人犯罪的数量。
[Abstract]:The problem of juvenile delinquency has always been concerned by the whole society. It is also a difficult problem that puzzles the judicial practice department and the legal theoretical circle, which affects the construction of a harmonious society. In order to build a well-off society in an all-round way to create a good environment need to be solved one of the important topics. In recent years, although the state has issued some laws and policies to prevent and reduce juvenile delinquency, however, the situation of juvenile delinquency is becoming more and more serious, and the situation of juvenile delinquency is gradually becoming younger, with the means of crime becoming adult and gang. Violence and other new characteristics have become a social problem that endangers social stability. By investigating the juvenile delinquency cases in Bazhong City from 2010 to 2012, this paper makes a brief probe into the causes and preventive measures of juvenile delinquency in Bazhong City. This paper consists of more than 17000 words and consists of four parts. The first part summarizes the characteristics of juvenile delinquency in Bazhong. The juvenile delinquency in this city has the characteristics of low culture, low age of crime, mainly infringing property crime, gang, intelligence of criminal means, becoming adult, and pure motive of committing crimes, which shows that the situation of juvenile delinquency in this city is becoming more and more serious. The second part analyzes the causes of juvenile delinquency in Bazhong City. There are many reasons for juvenile delinquency. This part mainly includes family reasons (changes in family structure, improper educational methods, bad influence of parents), school reasons (unclear purpose of running a school, moral education and legal education being a mere formality). This paper analyzes the causes of juvenile delinquency in the aspects of imperfect management system, bad communication of minors, bad social environment, lack of correct values and so on, which provides the basis for probing into the measures to prevent juvenile delinquency. The third part explores the measures to prevent juvenile delinquency in Bazhong City. There are many ways to prevent juvenile delinquency. This part is mainly from the angle of family prevention (establishing a harmonious and happy family, improving parents' educational quality, providing necessary help to parents, and changing the mode of exam-oriented education from the angle of school prevention. Strengthening the moral and legal education of minors, perfecting the school management system) purifying the social environment, preventing minors from having bad contacts, and enabling minors to grow up healthily in a happy atmosphere, etc. Thus reducing the number of juvenile delinquency.
