公安派出所在反家庭暴力实操中的困境与对策研究

【摘要】：自1980年7月签署《消除对妇女一切形式歧视公约》以来，我国在反家庭暴力方面取得了显著的成绩。但最新的调查显示，我国的反家庭暴力形势依然严峻。公安派出所作为国家权力的代表，在反家庭暴力中扮演着重要角色。经过广大基层公安干警的努力，我国公安派出所在发家暴工作中取得了一定的成绩，积累了大量的实践经验，对家庭暴力起到了一定的抑制作用。但目前公安派出所在反家庭暴力实操中依然面临着诸多问题。克服公安派出所在反家庭暴力实操中的困境，不仅要认真总结我国的经验与教训，也要积极借鉴国外的先进经验并吸取教训。本文在对美国、英国、丹麦等国家的反家庭暴力经验进行分析后，总结出的主要经验有：明确定义特征，强调规范技巧；设立专项法规，强制干预执行；政府积极协调，创建合作机制。在此基础上，本文认为西方国家的发家暴经验对于提升我国公安派出所在反家庭暴力实操中的工作水平有以下主要启示：健全立法、执法系统是反家庭暴力的有力措施，公安机关派出所在反家庭暴力实操中要转变观念，，重视联合社会各界推进反家庭暴力的进程。综上，本文认为破解公安派出所在反家庭暴力实操中困境的主要对策有：第一，完善法规，明确职责程序。明确公安派出所在反家庭暴力实操中的职责和工作程序，赋予公安派出所实施保护令制度的权力和职责，建立公安派出所防治家暴案件的分级监督机制，健全家暴案件中证据搜集与保护的法律和法规。第二，建设队伍，提高工作水平。深化反家庭暴力法规的教育，重视沟通技巧的培训，加强风险防控的培训，成立专业的反家庭暴力团队。第三，重视宣传，营造良好氛围。开展辖区内家暴问题的调研以掌握具体情况，提高妇女儿童自我权利意识和自我保护意识，积极组织或参与社区家庭活动营造和谐氛围。第四，加强合作，建设防治网络。建立公安派出所主导多方联动的家暴防治网络，研发推广公安派出所反家庭暴力专用手机信息平台。第五，总结经验，优化方式方法。制定前中后“三级预防”处置方案；设立反家庭暴力频道；充分发挥社区民警的独特作用；加大对多机构合作反家庭暴力的工作力度。本研究以公安派出所反家庭暴力实操为切入点，结合了笔者的工作实际与工作经验，深入研究了公安派出所在反家庭暴力实操中的困境，提出了一系列较具操作性、科学性的解决对策，对于反家庭暴力的理论研究和反家庭暴力实际工作都有较大的参考作用。
[Abstract]:Since the signing of the Convention on the Elimination of all forms of Discrimination against Women in July 1980, China has made remarkable achievements in combating domestic violence. But the latest survey shows that China's anti-domestic violence situation is still grim. As the representative of state power, police station plays an important role in anti-domestic violence. Through the efforts of the police at the grass-roots level, the police stations of our country have made certain achievements in the work of getting rich in the family, accumulated a lot of practical experience, and played a certain role in restraining domestic violence. However, the police station still faces many problems in anti-domestic violence. To overcome the plight of police station in anti-domestic violence, we should not only sum up the experience and lessons of our country, but also learn from the advanced experience of foreign countries. After analyzing the anti-domestic violence experiences of the United States, Britain, Denmark and other countries, the main experiences summarized in this paper are as follows: defining characteristics clearly, emphasizing normative skills, establishing special laws and regulations, enforcing intervention, coordinating actively by the government. Create a cooperative mechanism. On the basis of this, this paper holds that the experience of rich-rich family in western countries has the following main implications for improving the working level of anti-domestic violence in the police stations of our country: perfect legislation, law enforcement system is a powerful measure against domestic violence. The police station of the public security organ should change its concept in the practice of anti-domestic violence and attach importance to promoting the process of anti-domestic violence by unifying all walks of life of the society. In summary, this paper thinks that the main countermeasures to solve the plight of the police station in anti-domestic violence are: first, perfect the laws and regulations, clear the responsibility procedure. Make clear the duty and working procedure of police station in anti-domestic violence practice, endow the police station with the power and duty of implementing protection order system, establish the hierarchical supervision mechanism of preventing and controlling domestic violence cases in public security police station. Improve the laws and regulations for the collection and protection of evidence in domestic violence cases. Second, build a team and raise the level of work. Deepen the education of anti-domestic violence law, attach importance to the training of communication skills, strengthen the training of risk prevention and control, set up professional anti-domestic violence team. Third, attach importance to publicity and create a good atmosphere. To carry out investigation on domestic violence in the area of jurisdiction, to grasp the specific situation, to raise the awareness of self-rights and self-protection of women and children, and to actively organize or participate in community family activities to create a harmonious atmosphere. Fourth, strengthen cooperation and build prevention and control networks. The establishment of the police station led by multi-party interaction of domestic violence prevention and control network, research and promotion of police station anti-domestic violence dedicated mobile phone information platform. Fifth, summing up experience and optimizing methods. To formulate the "three-level prevention" disposal plan before, middle and later; to set up anti-domestic violence channel; to give full play to the unique role of community police; and to strengthen the work of multi-agency cooperation against domestic violence. This research takes the anti-domestic violence practice of police station as the breakthrough point, combines the author's work reality and work experience, deeply studies the plight of the police station in anti-domestic violence practice, and puts forward a series of more operable. The scientific solution can be used as a reference for the theoretical research of anti-domestic violence and the practical work of anti-domestic violence.
