论犯罪学的基本问题

【摘要】： 本文对犯罪学的形成、产生及发展过程进行了分析,并对犯罪学未来的发展前景进行了讨论,而且着重分析了中国犯罪学学科建设状况和未来的发展方向。全文共包括四个部分:犯罪学的形成和产生,犯罪学的基本内容,犯罪学学科制度化建设和未来犯罪学发展的方向。 首先,犯罪学作为一个科学认识犯罪现象的领域和一种专门化的知识形态,其形成和产生是社会现实需要、科学发展和学术精英推动的结果。犯罪学研究对象、研究方法及学科名称的确立,基本范畴和知识体系的逐步成熟,学科社会价值的实现,是犯罪学作为一门学科确立的标志。 其次,犯罪学是关于犯罪现象的知识体系,是一门寻求犯罪现象规律的社会科学。犯罪现象的复杂性决定了犯罪学跨学科的学科性质。犯罪行为、群体犯罪现象、犯罪原因、刑罚、保安处分、刑事政策及犯罪预防等是犯罪学的基本范畴,这些基本范畴的逻辑运动构成了犯罪学基本理论和知识体系。 本文第三部分主要分析了西方和中国犯罪学学科制度化建设的状况。西方犯罪学已经基本上完成了其学科制度化建设,面临的是如何进一步深化的问题。而中国犯罪学才刚刚开始其学科制度化建设,需要进一步在知识体系的完善、学术共同体的建设、专业人才的培养及应用性研究等方面作出努力。 本文最后一部分对犯罪学学科建设与发展的前景进行了预测性分析,这一分析是建立在犯罪学学科历史发展和学科建设现状的基础之上的。首先分析了当代犯罪学研究面临的危机、挑战和机遇,在此基础上对未来犯罪学的发展路径进行了分析,最后分析了当前中国犯罪学发展面临的困境,并对未来中国犯罪学的发展方向进行了探讨。
[Abstract]:This paper analyzes the formation, emergence and development of criminology, discusses the prospect of the future development of criminology, and emphatically analyzes the construction situation and future development direction of criminology in China. The thesis consists of four parts: the formation and emergence of criminology, the basic content of criminology, the institutionalization of criminology and the development direction of criminology in the future. Firstly, criminology, as a field of scientific understanding of crime phenomenon and a specialized knowledge form, is the result of social reality, scientific development and academic elite. The establishment of criminology research object, research method and subject name, the gradual maturity of basic category and knowledge system, and the realization of discipline social value are the symbols of criminology as a discipline. Secondly, criminology is the knowledge system of crime phenomenon and a social science seeking the law of crime phenomenon. The complexity of crime determines the interdisciplinary nature of criminology. The basic categories of criminology are crime behavior, group crime phenomenon, crime cause, penalty, security measure, criminal policy and crime prevention. The logic movement of these basic categories constitutes the basic theory and knowledge system of criminology. The third part of this article mainly analyzes the western and Chinese criminology discipline institutionalization construction situation. Western criminology has basically completed the institutionalization of its discipline and is faced with the problem of how to deepen it further. However, Chinese criminology has just begun to institutionalize its discipline, so it is necessary to make further efforts in improving the knowledge system, building academic community, training professional talents and applying research. The last part of this paper makes a predictive analysis on the prospect of the construction and development of criminology, which is based on the historical development of criminology and the present situation of discipline construction. First of all, it analyzes the crisis, challenge and opportunity that the contemporary criminology research faces, and then analyzes the development path of the future criminology, and finally analyzes the predicament of the current Chinese criminology development. The development direction of Chinese criminology in the future is also discussed.
