中国的反恐国际合作法律对策研究

【摘要】：恐怖主义在世界上已经存在了很长的时间，恐怖主义发展到今天，，已经突破了只在某一国范围内活动的边界，其国际化的特征越来越明显。2001年美国“9·11”事件的爆发，标志着国际恐怖主义上升到了历史的最新高度，恐怖主义日益成为危害人类共同福祉的毒瘤。从中国自身的反恐现状来说，主要的热点集中于西部地区。由“东突”运动和“藏独”势力制造的恐怖主义事件近年来有愈演愈烈之势。作为回应，一方面中国在进一步加大打击国内恐怖主义力度的同时，也积极主动地采取国际合作的方针谋求边境地区的和平安定。中国在不同场合阐述自身反恐政策的同时也加速了反恐国际合作方面的立法进程。从国内法角度讲，《刑法修正案（九）（草案）》中有关恐怖主义犯罪的修订，表明中国将加大对恐怖主义的打击态势。《反恐怖主义法（草案）》的出台表明，具有中国特色的反恐机制将在法律正式颁布以后形成。从国际法角度讲，在总结之前中国缔结的众多反恐国际条约的经验的基础上，由中国主导的《上海公约》的缔结，表明中国区域性反恐合作上升到了一个新的高度。近十年来，中国已经在反恐方面积累了较为丰富的经验，并且在一些热点的反恐问题上起到了主导作用。中国在反恐国际合作上，还需要进一步发挥联合国的平台作用，从维护中国自身的利益出发，积极促进反恐国际合作将是下一步反恐工作的重点。
[Abstract]:Terrorism has existed in the world for a long time. Today, terrorism has broken through the boundaries that only operate within the scope of a certain country, and its internationalized characteristics are becoming more and more obvious. The outbreak of the "11 September" incident in the United States in 2001,It marks the rise of international terrorism to the latest level in history. Terrorism has increasingly become a cancer that endangers the common welfare of mankind.From China's own anti-terrorism situation, the main focus is in the western region.The terrorist incidents caused by the East Turkistan Movement and Tibetan Independence Forces have become more and more serious in recent years.In response, while further stepping up efforts to combat domestic terrorism, China has also taken the initiative to adopt the policy of international cooperation to seek peace and stability in the border areas.China has also accelerated the process of legislation on international cooperation in the fight against terrorism while explaining its anti-terrorism policies on various occasions.From the point of view of domestic law, the revision of terrorist crimes in the Amendment to the Criminal Law (draft) indicates that China will step up its fight against terrorism.The anti-terrorism mechanism with Chinese characteristics will be formed after the promulgation of the law.From the point of view of international law, the conclusion of the Shanghai Convention led by China on the basis of summing up the experience of many international treaties on counter-terrorism concluded by China indicates that China's regional anti-terrorism cooperation has risen to a new height.In the past decade, China has accumulated rich experience in anti-terrorism and played a leading role in some hot issues.In international cooperation against terrorism, China also needs to further exert the role of the United Nations as a platform. In order to safeguard China's own interests, actively promoting international cooperation against terrorism will be the focus of the next step of counter-terrorism work.
