完善人大代表与选民联系制度的法律思考

【摘要】：本文将人大代表与选民联系制度分为选举、履职、监督罢免三个环节,并从“静态的法律规范”与“动态的制度运行”双重角度出发,对这三个环节进行了规范和实践的双重考量,试图通过这种方式更清晰地认识人大代表与选民联系制度的本质,找出不足之处并在此基础上提出意见。全文包括引言、正文、结语三部分。引言部分对研究背景和研究思路进行了说明,并提出了人大代表联系选民制度是动态的人大代表制度这一论断。正文部分则主要从理论基础、现状分析、对策研究三个部分进行了研究。第一部分对研究所需要的基本理论进行了简要介绍,主要包括委托说与集中代表说这两种议员与选民关系的学说,以及我国学者对人大代表与选民关系的研究。并在最后,指出了影响人大代表与选民联系的三种因素。第二部分对人大代表与选民联系制度进行了“静态的法律规范”与“动态的制度运行”的双重分析,依然是按照选举、履职、监督罢免这三步进行,其实质就是按照逻辑起点、运行内容、制度保障这个思路对人大代表与选民联系制度进行了分析。在“静态的法律规范”中,对我国现行的法律规范从学理上进行了分析,指出了其中不合理的地方。在“动态的制度运行”中,则是结合多个典型事件进行了分析,从而发现法律规范在实践中存在的问题。第三部分是在之前分析的基础上,对人大代表与选民联系制度进行了反思,提出了相关的建议。结语部分则通过上述研究,肯定了人大代表联系选民制度就是动态的人大代表制度,指出若要完善人大代表与选民联系制度,就必须从选举、履职、监督罢免多个环节入手。
[Abstract]:This paper divides the contact system between NPC deputies and voters into three parts: election, discharge of duties, supervision and dismissal, and from the perspective of "static legal norms" and "dynamic system operation",Through the double consideration of these three links, this paper tries to understand clearly the essence of the system of communication between the deputies to the people's Congress and the voters, and to find out the shortcomings and put forward the opinions on this basis.The full text includes three parts: introduction, text and conclusion.The introduction explains the research background and research ideas, and puts forward the conclusion that the NPC deputy system is a dynamic one.The text is mainly from the theoretical basis, analysis of the status quo, countermeasures three parts of the study.The first part gives a brief introduction to the basic theory of the research, including the theory of the relationship between the deputies to the people's Congress and the voters, and the study of the relationship between the deputies to the people's Congress and the voters.In the end, the paper points out three factors that affect the relationship between NPC deputies and voters.The second part makes a double analysis of the "static legal norms" and "dynamic system operation" of the system of communication between the deputies to the people's Congress and the voters. It is still carried out in accordance with the three steps of election, discharge of duties, supervision and dismissal, and its essence is to follow the logical starting point.Operation content, system safeguard this train of thought to the people's Congress deputy and voter contact system has carried on the analysis.In "static legal norms", the author analyzes the current legal norms of our country theoretically, and points out the unreasonable points among them.In the "dynamic system operation", the author analyzes several typical events and finds out the problems existing in the practice of legal norms.On the basis of previous analysis, the third part reflects on the system of communication between NPC deputies and voters, and puts forward some relevant suggestions.The conclusion part, through the above research, affirms that the system of people's Congress deputies connecting with voters is a dynamic system of deputies to the people's Congress, and points out that if we want to perfect the system of linking people's Congress deputies to voters, we must start with election, exercise our duties, supervise and recall many links.
