论合适成年人参与制度的完善

【摘要】：随着我国少年司法制度的不断探索与发展，对未成年人权益的保护一直备受专家和学者们的关注。少年刑事诉讼中，监护人不出庭履行法定代理人职责的现象并不少见，其对未成年犯罪嫌疑人所造成的潜在危害已被司法界所认识。如何设立符合未成年犯罪嫌疑人的特殊刑事诉讼程序，是我国少年司法实践一直探寻的目标。合适成年人参与制度正是本着儿童利益最大原则的理念，根据未成年犯罪嫌疑人生理、心理的特殊性，为其专门设计的一项权利。目前，我国的法律和司法解释中只有关于合适成年人参与制度的初步规定，在司法实践中，试点地区的合适成年人参与制度还存在很多不足之处。基于“教育、感化、挽救”未成年人的主题，在减少和预防未成年人犯罪方面，建立系统、完善的合适成年人参与制度十分必要。合适成年人参与制度不仅有利于涉罪未成年人的身心健康发展，而且可以有效地监督讯问人员的不法行为，提高证据的证明力，实现司法公正。本文以合适成年人参与制度的基本理论为切入点，结合各地的试点工作，，总结出该制度在我国适用中取得的经验和存在的问题，我国目前的国情为进一步深化和完善合适成年人参与制度提供了可行性条件。合适成年人的选任、范围、角色等是完善合适成年人参与制度的重要内容，建立合适成年人全程参与模式是完善该制度的亮点。合适成年人参与制度的完善是一项系统的过程，还需要理论界和司法实务界给予更多的关注。
[Abstract]:With the continuous exploration and development of the juvenile justice system in China, the protection of the rights and interests of minors has been paid much attention by experts and scholars. In juvenile criminal proceedings, the phenomenon that the guardian does not appear in court to perform the legal agent is not uncommon, and its potential harm to juvenile suspects has been recognized by the judicial circle. The establishment of a special criminal procedure which conforms to the juvenile suspects is the goal that the juvenile judicial practice has always sought in our country. The right to participate in the system of adult participation is based on the principle of the maximum principle of children's interests, according to the physiological and psychological particularity of the juvenile suspects, and a special right to be designed for it.
At present, in the legal and judicial interpretations of our country, there are only preliminary provisions on the appropriate adult participation system. In the judicial practice, there are still many shortcomings in the system of adult participation in the pilot area. Based on the theme of "education, sensitivity and saving", the system is established to reduce and prevent juvenile delinquency. The appropriate adult participation system is very necessary. Appropriate adult participation system is not only conducive to the physical and mental health of the juvenile involved, but also can effectively monitor the wrongful behavior of the interrogator, improve the proof of the evidence, and realize the judicial justice. This article is based on the basic theory of the appropriate adult ginseng and the system. The experience and existing problems in the application of the system in our country are summed up. The present conditions of our country provide the feasible conditions for further deepening and perfecting the appropriate adult participation system. The full participation pattern of adults is the highlight of the system. It is a systematic process to improve the appropriate adult participation system, and more attention should be given to the theoretical and judicial circles.
