【摘要】：公民参与的法制化即以法律的形式保障和规范公民参与的行为,使公民参与行为规范化、程序化,构建保证国家公民参与行为顺利实施的法律制度环境。公民参与保证了国家公民在国家政治、经济、社会等国家活动中的影响力,是实现社会效率和公共利益的有效方式。公民社会的法制化不仅能规范公民参与行为,促进我国公共行政过程中的科学化,同时对于推动我国的社会发展也有着具有极大的现实意义。我们必须结合我国现有的实际情况,在我国的国家和社会性质的基础上,努力推进中国公民参与制度的法制化进程。在这一过程中,首先必须要发挥宪法作为我国根本大法的规范性作用,对保障公民参与的法条进行合理修缮,并引导公民参与其它相关法律的修订和完善,努力提高公信力,使公民参与行为具备更强的法律效力。其次,要在行政和司法领域加强对保障公民参与权的落实,并完善人民代表大会制度,保障公民参与行为的制度化和程序化。最后,完善我国社会民间组织,并加强对其法律保护,介以发挥其积极作用,引导和规范公民参与行为,以达到培养公民意识、提高公民参与能力目的,最终推动我国公民参与活动的良好发展,介以推进中国的法制及整个社会的全面进步。
[Abstract]:The legalization of citizen participation is to guarantee and standardize the behavior of citizen participation in the form of law, to standardize and program the behavior of citizen participation, and to construct the legal system environment to guarantee the smooth implementation of national citizen participation behavior. Citizen participation ensures the influence of national citizens in national political, economic and social activities, and is an effective way to realize social efficiency and public interest. The legalization of civil society can not only regulate the behavior of citizen participation and promote the scientific process of public administration in our country, but also has great practical significance to promote the social development of our country. We must make great efforts to promote the legalization of the system of citizen participation in China on the basis of the national and social nature of our country in the light of the actual situation of our country. In this process, first of all, we must give full play to the normative role of the Constitution as the fundamental law of our country, carry out reasonable repairs to the laws guaranteeing citizen participation, and guide citizens to participate in the revision and perfection of other relevant laws, and strive to improve the credibility of the law. Make citizen participate behavior to have stronger legal effect. Secondly, in the administrative and judicial fields, we should strengthen the implementation of the right to protect citizens' participation, improve the system of people's congresses, and ensure the institutionalization and procedure of citizens' participation. Finally, we should perfect the civil society organizations of our country, strengthen the legal protection to them, so as to give full play to their positive role, guide and standardize the behavior of citizen participation, in order to cultivate the citizen consciousness and improve the ability of citizen participation. Finally, to promote the good development of citizen participation in China, to promote the Chinese legal system and the overall progress of society.
